Pennsylvania attorney general refuses to defend state in same-sex lawsuit

PHILADELPHIA (Reuters) - Pennsylvania Attorney General Kathleen Kane refused on Thursday to fight a lawsuit brought by the American Civil Liberties Union challenging the state's ban on same-sex marriage.

The lawsuit is believed to be the first federal case since the U.S. Supreme Court ruled on June 26 that the U.S. government must recognize same-sex marriages in states where it is legal.

Kane, a Democrat who supports same-sex marriage, announced her decision at a press conference in the National Constitution Center in historic Philadelphia.

By declining to defend the state, Kane effectively tosses the issue to Governor Tom Corbett, who can decide to appoint another state lawyer to the task.

Kane and Corbett, a Republican who opposes gay marriage, are both named in the federal lawsuit that was filed in Harrisburg this week.

The ACLU sued on behalf of 23 people, including potential marriage candidates whose unions would not be recognized under current Pennsylvania law.

The lawsuit asks the court to allow the plaintiffs and all other same-sex couples the right to marry in Pennsylvania, and also asks that the marriages of same-sex couples validly obtained in other states be recognized by the state.

The supreme court ruled on prop 8 like this - if the state will not defend its laws no one can and we are all screwed.

Yep, this is the new liberal tactic. Just refuse to defend a law in court, then the court has no choice but to rule for homosexual marriage.

The liberals would be outraged if this tactic were used against any law which liberals favored. But we all know that liberals do no have consistent standards. The criteria are, whatever pushes forward the liberal agenda.

He's a lawyer - for him oaths and the law are just there to be used or not used as convenient.

Kathleen Kane has the same type of arrogant attitude as ObaMao. She was narrowly elected in November by a bare majority of clueless voters who thought it would be fashionable to put a woman in the job.

So the ACLU, by default, gets to redefine marriage for everyone. Gov. Corbett could order her to do the job she was elected to do, but since she was elected and not appointed, I'm not sure how far that would get.

When I voted for General Kane last November this wasn’t on the horizon—and I voted for her only because her opponent had been part of the problem with the slow pace of the Jerry Sandusky poofter pedophilia investigation.

Buyers remorse? Yea verily.

I hope it keeps you awake at night for a long, long time. Never, EVER vote for a dimocRAT, I don’t care what reason you thought it was right. Obviously you now see the error of your ways.

It has been since Ronald Reagan was in office that a dimocRAT had any measure of worth. I’ll take a slow Republican over a dimocRAT 100 out of 100 times.

This is anarchy or the mark of a totalitarian regime which enforces laws only when and where they want against their enemies. Kane needs to be quickly removed from office by the Governor or the people. This is also malfeasance in office. Perhaps there is a law enforcement angle that could be pursed.
