Honestly, I would expect the Justice Department to proceed with charges against Zimmerman, whether or not he meets the requirements, simply to punitively punish him financially from the costs of defending himself, and by the emotional toll it will cost him to spend the next few years of his life tied up in this.

The cost to the United States doesn't matter to Obama or Holder, and neither does eventually winning or losing.
