Both the DHS Secretary and Dep Sec positions need to be filled.
The USCIS director has been nominated for the #2 slot, but just got caught doing immigration related favors for one of Hillary Clinton’s brothers.
I could see this as an attempt to get Lee installed, as a compromise, as the Dep Sec.
