AS: The determination of which services continue during an appropriations lapse is not affected by whether the costs of shutdown exceed the costs of maintaining services.

From the memorandum, in FAQ:

The Antideficiency Act prohibits agencies from incurring obligations that are in advance of, or that
exceed, an appropriation. Thus, with certain limited exceptions, an agency may not incur
obligations when the funding source for the obligation is an appropriation that has lapsed.

What is the Antidificiency Act, and why does the Executive Branch choose to so selectively enforce it?

With this logic, we should have been shut down years ago the first time a budget was not passed by both legislative bodies and signed by the President.
