Companies Must Justify Their Workforce Decisions Under Obama’s Latest Rewrite

(CNSNews.com) – Once again acting without Congress, President Obama has unilaterally changed his signature health insurance law, delaying its employer mandate – the second time he’s done this -- to 2016, after the mid-term elections.

BUT: To be eligible for the additional delay, the Obama administration says an employer “may not reduce the size of its workforce or the overall hours of service of its employees” unless it can justify those reductions to the Internal Revenue Service.

On Monday, the administration issued new regulations saying that employers with 50 to 99 workers don’t need to provide minimum essential coverage until 2016 – two years beyond what’s written in the law.

But the regulations also say that effective yesterday, employers may not shed employees or work hours just to get below the 100-employee threshold – and thus avoid Obamacare’s penalties for another full year.

If they were smart they would have done that months ago to avoid the look back for average hours and employee numbers.

Oh, okay, lemme get this straight.

If you want the waiver, you can’t fire anybody or significantly reduce your work force, and if you don’t won’t the waiver you can fire and reduce at will?

The king has issued a new decree. How in the hell can he dictate this crap? This is making up the rules as you go along and clearly places him in the overriding the law to “do as I see fit” category. If he’s trying to kill cpitlism AND the economy AND the U.S. i’d say he gets an A+

Soon it will be illegal to stop working or, if you own a business, reduce your workforce.

And 2016. Just in time for a democrat to run on health care reform because those mean ol’ republican whities are trying to take health care from women children and minorities.

I hate to be a defeatist but...

I’d justify it by saying the ACA is putting an undue strain on my business and affecting the amount of income earned which is reducing the amount of taxes I am paying to the IRS. WTH are they going to say to that?!

I wouldn't blame a small business for just throwing in the towel and closing their doors. Of course, that will probably have to be "justified" to the IRS too...
