It’s that darn 14th Amendent.
It should have been repealed after Recinstruction.

You are correct, and that makes it a 10th amendment issue, completely up the the States and The People. But the issue is not being decided by "the States" and "The People". It is being decided by judges, which is the problem with a 10th Amendment solution.
