No doubt it should be legal. Lots of laws are stupid. And, you're right: there are some safety issues, but distilling 'shine isn't rocket science. I've heard that even unedumacated hillbillies are fully capable of doing a fine job of it.

It is legal. What is illegal is the sale of said alcohol. (At least in most states.)

Actually, the use of any still that is not approved (i.e. taxable) by the fedgov is illegal, even for personal use.
