The complaint actually reads more like an attempt at healing than a serious legal claim. To that extent, I am sympathetic. But the strictly legal issues and theory of recovery to be gleaned from it deserve comment.
This is in the class of claims that are barred by a 2005 law, the Protection of Lawful Commerce in Arms Act (PLCAA). Congress passed the PLCAA in response to several years worth of creative municipal lawsuits against the gun industry. Former Pennsylvania Governor Ed Rendell explained in a speech to the American Bar Association that the litigation was designed to avoid consolidation and stretch the ability of gun makers to pay for legal defense in dozens of jurisdictions at once.

Protection of Lawful Commerce Act be DAMNED.
These people have Obama on THEIR side - and Obama has a pen and a cell phone.
Send a friend of the courts brief stating “You don’t sue auto manufacturers for the deaths caused by drunk drivers as that is morally, legally, and sensibly bankrupt and plainly ‘stupid’.”
PretenCe, must have been written by a Brit.
Shhhhh! Don’t give them any ideas.
Will next manufacturers of knives be held responsible for stabbing deaths? A
Well no silly. Only guns are evil. All other violence doesn’t count apparently. Of course I thought to be evil or malevolent, you had to have a living cell involved. Silly me I guess.
I was in Newtown, and more specifically, Sandy Hook, this past October. Half of the residents were God fearing Second Amendment brethren, and the other half were self flagellation types, trying to make this “moment in the spotlight” live forever.
Having lived in the region (but now live out West), I can tell you, a LOT of wacky things have happened in Newtown. Must have been built on ancient Indian Burial grounds, or something.
My family were from NY and PA but due to my dad’s tenure in the Navy (and mine and youngest daughter too) we never settled in that area. Pretty sad to see what’s become of the place where this country got it’s start. We live in the west too now after I retired but are seeing a lot of lib influence in NV. Las Vegas/hairyscreed/LVunions hurt the rest of the state.
I lived in an adjacent town growing up. It was defined by the psychiatric hospital.
Sad, indeed. Thanks for your reply!
I lived in Danbury, 1964-79. In an era where hitch hiking was popular, there was one hard and fast rule; don’t pick up hitch hikers in Newtown. My pal’s brother worked at Fairfield Hills, for a while.....
