I have to disagree, blast. It is your right to remain silent. This is remaining silent. As we saw with the Lois Lerner “taking the 5th” garbage, as soon as you start talking, you’ve waived that right, and LEOs will claim anything in court to make a case stick.
It may piss them off, but if all of your paperwork is in order, they have no legal right to make you open your window. And I’ve yet to meet a LEO who wants to spend weeks going through the legal system on a “hunch.”
Well my greater point in this is that when you go looking for trouble, you will generally find it. In my never to be humble opinion, this is defying/disrespecting law enforcement and that never ends so well. Human nature is what it is and LEOs ,being human beings will react the same as you would if one of your neighbors or employee or fill in the blanks defied you. Dont be stupid and don’t give them reason to jack you up!!
Most cops don't play lil games. Some of the cards indicate, don't roll the window down unless the officer threatens to shatter it. At this point, he’z pissed.
You roll the window down, the cop says he detected the odor of marijuana or you were behaving in a suspicious manner. Now your standing along the roadway getting the 3rd degree or having your possessions rifled.
When your standing along the road, the officer “ for his safety” begins to grab your wrist to place cuffs on you until the investigation is complete....you pull your hand away ever so slightly because you happen to be the type that speaks with your hands. Now you have a nice cherry on your cheek and a broken front tooth when your melon bounces off the curb. Now the officer has charged you with felony resisting.
Fast forward a few months. After laying out bond, hiring a lawyer, a few hundred to get your vehicle out of impound lot, visit to the dentist....your in court. Will you win? Is the officer highly respected veteran and cozy with the judge for providing private security for his daughter's 21st birthday party?
Boom, you win. The judge dismisses your case, then what? You spend thousands more filing suit. Months later he prevails based on the fact he was acting on reasonable suspicion and you failed to comply by first playing games with officers that put their lives on the line by placing a dumb placard in the window/refusing to cooperate with the states anti-drunk driving efforts that save lives and protect the public, then by resisting/impeding an investigation.
Thank goodness I live in Texas...it is illegal for LE to setup DUI checkpoints. I think they are an abuse of power and grossly unconstitutional, but one things for damn sure, you'd better have the stomach for being roughed up or at the very least scrutinized with extreme prejudice. Cops have become hyper vigilant, everyone is a suspect.
