The Obamacare death panel has a constitutional problem

She was vilified as ignorant, alarmist, extreme and right-wing when former Alaska governor and 2008 vice presidential candidate Sarah Palin tried to tell Americans that yes, the Affordable Care Act – a.k.a. Obamacare – created so-called “death panels.”

But of course, she has since been proven correct, even though they are not identified as “death panels” specifically in the language of the law. President Obama and the Democrats who passed this abomination would never be so politically bold or so politically honest; then-Speaker Nancy Pelosi of California famously said that Congress would “have to pass the bill so that” Americans “can find out what is in it.”

I see only two possible solutions.
The Article V Convention of the States is the less bloody of the two.

...of the territory once known as “the United States of America”.

That territory is badly balkanized, divided into roughly two spheres, one part designated the “red” regions (which are nearly contiguous) and scattered among this vastly larger “red” area, are little pockets of “blue” districts, none of which would be self-supporting without the tribute sent to them from the “red” regions.

Obama hired Gruber as the death panel handyman----Zeke Emanuel was a key player. All of them itching to serve the Progressive cause. Here's how it worked

Clearly---Gruber was handed the Marxist dream plan FIRST. Then Obama bribed money-hungry Gruber w/ $400,000 hefty tax dollars to build the healthcare model that he and lock-stepping Dems, could sell to gullible Americans.

PROGRESSIVE POISON The so-called "Cadillac tax" was part of the Obama/Gruber conspiracy designed: (1) to destroy wealthy insurance companies......targets of Progressive virulent hatred, and, (2) to deny end-of-life care to the elderly....deplored by Progressive Poisoners in our midst.

Other Progressive Poisons: healthcare rationing, pulling $750 million out of Medicare, death panels.......

....and the Marxist Dream Triumphant: decimating intergenerational transfers of wealth (a longtime Progressive bugaboo); grandma/pa's holdings go to the govt---not to you.

Gruber delivered Progressive Poison in spades: The preening, duplicitous Gruber---the embodiment of cockamamie far-left thinking---believed it was his moral duty to lie, deceive and collude w/ the US govt......so that these revolting ideas could be imposed on "sub-mental defectives' taking up valuable space in their Utopian America.

Loyal foot-soldier Gruber, in obeisance to the Marxist dream, invented mechanisms to serve Obama's Marxist obsession w/ wealth transfer---as candidate Obama told Joe the Plumber---his plan was to redistribute the wealth:

(1) throwing Americans off affordable health plans
while assuring them they could "keep their plans,"

(2) nationalizing 1/6 of the US economy,

3) installing IPAB's (healthcare rationing--death panels),

(4) decimating intergenerational transfers of wealth a longtime Progressive bugaboo;
via Obamacare, grandma/pa's holdings go to the govt---not to you,

(5) pulling $750 billion out of Medicare (another Progressive irritant---giving the elderly healthcare),

(6) drug-rationing---see death panels,

(8) outright abandoning seniors and the chronically ill,

(9) transferring wealth from healthy young Americans to subsidize healthcare for others.

Obama organized Democrats into a lock-stepping cheerleading squad to force the Progressive Poison down the throats of recalcitrant Americans.

NOTE The fraudulent methods used to package Obamacare are a clue as to how Obama was packaged as a candidate----except his handlers effectively papered-over his Progressive Poison.

The bloody option may be the way to go, however, it will be much more viable if the non-bloody option (Art V) is at least tried, but then fails.

As a side note to this thread, please consider the following. The biggest constitutional problem that Obamacare has is that the corrupt, Democratic-controlled Congress that passed Obamacare wrongly ignored first petitioning the states for a healthcare amendment to the Constitution. Such an amendment would have given Congress the constitutional authority that it needs to establish a national healthcare program if the states had ratified it.

The location of American power:

Entirely with the states under the Articles of Confederation.

Partly with the general government, and mostly with the states under the Framers’ constitution.

Post 17th Amendment, mostly with the general government, and in time, less and less with the states.

Increasingly within the executive department since LBJ, yet subject to congressional oversight.

Within politburos under Obama, two of which are entirely separated from free government and congressional oversight. These are the IPAB, and CFPB. The ancients would recognize this arrangement as pure tyranny.

In the future, should Leftists regain congress and the presidency, expect wholesale transfer of power to many additional star-chambers.
