If the DoJ refuses to prosecute, there is nothing Congress can do. Well they can defund them, but shucks they would be blamed for shutting the government down. Better Red than Dead I guess.

You are correct that Congress does have the power of the purse, but Boehner and McConnell have already surrendered that as a bargaining tool. But you can't really blame Gowdy for that.
