I am no UCMJ expert, but it seems to me the article 99 is more serious than the article 85. The reason, and the article allude to this, is that Bergdahl deserted in a combat zone and went to the enemy. My quick research suggests thousands did desert in Iraq and Afghanistan, but many left before deployment and after already serving tours. Many only received one year jail time. I suspect Bergdahl is in for a longer prison term.
Any FR veterans want to weigh in on article 104 not being charged???

Don't underestimate that word “Misbehavior” and what it really covers. I heard some one talk about this earlier today...and this covers even the most despicable behavior.....they aren't going to reveal the specifics at this time for obvious reasons.

Desertion in time of war is punishable by firing squad. What is this 5 year sentence nonsense I’m hearing. And he also collaborated with the enemy, which is treason.
Stonewall Jackson would have had him shot and no telling what punishment Patton would have had up his sleeve for the traitor. Now that’s a scary thought.
