If he’s tried in federal court, Loretta Lynch gets the final say on the death penalty. And she will say no.
I doubt he will be tried in Federal court - there would need to be a federal "hook" to bring the case from D.C. Superior court over into Federal court, and Federal prosecutions for murder are pretty rare outside of the terrorism/organized crime context.
D.C. itself does not have the death penalty.
