Correct me if I’m wrong, but wasn’t this supposed to be the time we we’re going to praise Justice Roberts for deftly handling the ACA situation by calling it a ‘tax’?

Today was the day we were going to sing his praises for being so smart...much smarter than all of us who said this whole thing was unconstitutional.

Not to mention the unconstitutionally un-American way it was passed.

I was not surprised. Our courts seem to be trending downward these days, away from sensible business practices and individual rights.

From the Opinion of the Court:

At the outset, it might seem that a Federal Exchange cannot fulfill this requirement. After all, the Act defines “State” to mean “each of the 50 States and the District of Columbia”—a definition that does not include the Federal Government. 42 U. S. C. §18024(d). But when read in context, “with a view to [its] place in the overall statutory scheme,” the meaning of the phrase“ established by the State” is not so clear.

So Roberts claims that a clearly written statutory provision can be converted to being ambiguous by reading that provision "in context". What is that context? I'm guessing the Liberal Messiah knows and Roberts wants it kept a secret.

SCOTUS approves of the 0ligopoly controlling everything, no matter what the law says.

It is far worse than just the atrocity of Obamacare. It is about THE CONSTITUTION and the obviously overt attempt to destroy it. The SCOTUS just broke the law, in order to allow continued breaking of the law.

A Constitutional crime and a DANGEROUS precedent, second time around.

Well, just as I and a few others predicted, the communists makeup of the Supreme Court will kick us in the ars and they disobeyed the written law on Obamacare.

The crucial point is that the Supreme Court has no business rewriting laws to keep them alive, because the original authors were idiots whose poorly-thought-out power grab proves unsustainable. The Supreme Court is not a super-legislature intended to fix problems, as Roberts has now done twice with respect to ObamaCare.

If that role has now been forever changed with the precedent of Roberts’ ObamaCare decisions, then it is time to strip Supreme Court justices of lifetime tenure and subject them to frequent elections and the possibility of recall, just like any other legislator. Otherwise, we’re going to get more of what happened in this disastrous ruling; indeed, power-hungry members of the legislature have every reason to aim high and grab as much power as they can with every law they create, secure in the knowledge that the Supreme Court super-legislature will rescue them from their arrogance and folly, at absolutely zero political cost.

Heed these words of Justice Antonin Scalia, Republicans. Memorize them. This really is the beginning of a political war, not the end… whether you feel like fighting or not....read more...
