A federal judge is being asked to seize the USB flash drive that holds copies of former Secretary of State Hillary Clintons private emails.
Conservative legal activist Larry Klayman on Wednesday filed a motion to have a judge take control of the flash drive, which is being held by David Kendall, Clintons lawyer, as part of his ongoing racketeering lawsuit against the Democratic presidential frontrunner.
This court has a responsibility to preserve evidence and must do so to avoid its destruction, Klayman wrote in the new motion. Importantly, plaintiff has not requested to see the documents, hard and thumb drives at this time, but simply asked that this court take them into its custody for safekeeping.
Klayman has claimed that Clinton and her husband, former President Bill Clinton, have violated the Racketeer Influenced and Corrupt Organizations (RICO) Act by deleting emails and covering up her communications to avoid responding to Freedom of Information Act requests. The missing emails would show how Clinton used waivers and sold her influence in exchange for donations to the Clinton Foundation, he has alleged.
In his Wednesday filing, Klayman noted that the FBI has recently taken an interest in the flash drive a revelation earlier this week that built on the scrutiny of Clintons email practices. Transparency advocates and critics of Clinton have been livid at her use of a personal email address on a private server throughout her term in office. . .

The actions of this nation’s highest ranking officials would indicate RICO is vastly underused . if at all. When it comes to gubamental corruption .. No one seems to CAIR at DoJ. I mwonder why?

What I am wondering about though is what prevents this slippery bag of cr*p hillary from simply having Kendall destroy the flash drive or have Kendall tell the FBI that he has misplaced / lost the flash drive? What happens in this instance?
The Clinton Foundation bot 47 of those thumb drives to give to our staff for Martin Luther Horowitz Day. Somehow, the one we gave to Dave Kendall must have gotten mixed up. We will investigate the situation, develop a report, and get back to you with our findings no later than February 02, 2016.

Yes. The electronic equivalent of “I don’t remember. (My brain’s in a blender.)”
Back in the 1970’s when I worked for the Navy, a company sent me a “delivery tape” on the contract due date. However we couldn’t read it. When we took it over to our local Naval Security Agency, they examined it and told us that it was a completely virgin tape. It had never been touched. This gave the company another month to get the delivery together. They claimed it was just a “CM problem”.

The legal maneuver will be that Klayman has “no standing” to file such a motion.
