Money put aside (FSA and HSA), tax-free and to be used as individuals see fit, is money in your pocket that government can’t get their hands on.

It is against their whole beings/believes to lawmakers and government at any level that any money does not belong to them.

FSA is use it or lose it. It is not of great value to healthy people since you have to know in advance what the uncovered expenses are. If your healthy, HSA seems like a great idea if available. I suspect the writers of the law knew the people likely to take advantage of the plans are in the 25% tax bracket and above.
