The Bergdahl Case Gets Curiouser and Curiouser

The odd case of Army deserter Bowe Bergdahl got even weirder during his Article 32 hearing conducted by Army officials Thursday and Friday last week. The Article 32 procedure is the military equivalent of a civilian grand jury, except that the accused has quite a few more rights. Unlike a typical grand jury, the Article 32 is presented before a single hearing officer, not held in secret, allows defense counsel to be present and to cross-examine witnesses, and to call their own. All of this occurred at Bergdahl’s hearing.

Army prosecutors called Bergdahl’s immediate chain of command to testify. They established that Bergdahl left his post without orders, but also that Bergdahl had been “great” soldier until his desertion. Bergdahl’s former platoon leader testified that while he led exhausting patrols to find the soldier following his disappearance, this did not result in the loss of any other troops.

Bergdahl’s former company commander confirmed this. On cross-examination the platoon leader appeared to agree with Bergdahl’s defense attorney that if the soldier had an attitude problem it was that he felt his superiors were not aggressive enough in fighting the Taliban.

Back in 2014 Army investigating officer Major General Kenneth Dahl interviewed Bergdahl. As an active duty soldier Bergdahl could be ordered to sit down for the interview, but might have asserted his 5th Amendment right against self-incrimination, and refused to answer General Dahl’s questions. Press reports indicated that this did not happen, but also did not reveal the content of the interview. Since I found it hard to believe that Bergdahl’s attorneys would allow him to speak to the investigating officer unless he essentially had nothing incriminating to say, I assumed he claimed to have no memory of the events that led to his capture by the Taliban,

So his defense team is claiming that he left his post with the intent to hike to another post 19 miles away and thus did not desert but merely went AWOL.

For whatever reason Bergdahl has created during the years since he went Absent Without Leave, he still left his post without permission in the face of the enemy.

Narcissism. It is the best way to understand all that happens in the White House these days. Obama is a spoiled child who does what he wants and nobody is telling hi otherwise or he will tantrum!!! He cannot ever be wrong or make a mistake or be embarrassed or shamed.

In order to ensure none of the above happens to the little spoiled child, the game is constantly rigged through intimidation and lies. From fixing employment data, using the IRS to intimidate and punish enemies, using the Justice Department to threaten reporters, manipulating intelligence data, not releasing all the parts of a deal with Iran, releasing false economic growth data this is revised later (after nobody is paying attention), passing out white coats to janitors to make it look like ALL docs support Obamacare, releasing false data on Obamacare, labeling anything wrong that you are caught red handed doing as a “phony scandal” you name it, the regime will engage in whatever it takes to bend the truth to protect the child.

This is but the latest example. If Bergdhal were found guilty or heck, even tried for a major crime after the child traded five of the worst terrorists for Bergdahl’s freedom, the embarrassment would be astronomical. Therefore, through intimidation the Army must be made to rig the game so that the child is not wounded. The national security of our country be damned, protect the child, God’s most perfect creation.

The MSM? They are part of the child as are any overprotective, over indulging parent. Don’t expect them to do anything but use the daily falsities generated by the regime to give themselves plausible deniability to continue to protect the child. “My child is killing the economy?!?! No way, the unemployment numbers are low. I don’t wanna hear about underemployed, that’s irrelevant to my child! He is the most perfect creature. Why are you criticizing the child? Do you hate children, especially black ones? Racist child hater!!”

What about charging his immediate and command for dereliction of duty for failing to file a AWOL report?

I can’t believe the incompetence in his unit, the failure to file this paper work is lending more credibility to his bs story.

Major General Kenneth Dahl, apparently a douchebag butt boy, looking for a promotion from his master. To say Bergdahl should not do time preposterous. Bergdahl is responsible for the battle field deaths of American heros, he should get the firing squad.

It is never a good assumption to think that a military trial is anything like a civilian trial. Many consider it to be much fairer, because guilt and innocence, not just lawyer’s tricks, truly matter.

The one thing that will *nuke* a military court martial is even the slightest hint of “command interference”, in either direction.

While there is a presiding officer, he has just one vote, and the rest of the board may ask questions during the trial, of anyone, including the attorneys. If anyone behaves surly or disrespectfully, or heaven help them, lie and get caught, they can get in serious trouble.

Many are the times when the prosecutor unintentionally helps the defense and visa versa. And this is okay, because the *purpose* of a court martial is *not* justice, but “to protect order and discipline in the military.”

This means that the penalty phase can be extraordinary.

Murdering someone might only get a soldier four years in prison. But molesting a child could get life without parole, because the latter is considered “prejudicial to good order and discipline”, and really upsets soldiers.

Mysteriously, Obama has had top Army officers running scared for years. Therefore he (Obama) will get whatever verdict (outcome) he wants in the Bergdahl case.

When Trump gets into the Oval Office, his very first duty should be to launch a search to find a REAL officer in each of the Services and appoint that officer to clean up Obamas mess in each respective service. Indeed, if necessary, “Seniority” should be thrown out the window in favor of finding the best “MAN” for the job.

The officers that showed no backbone during Obamas reign should be retired.

Then, back at West Point, a one year non elective course should immediately be started up concerning an Army Officers “oath of office” with respect to the part about defending against “all enemies, foreign AND DOMESTIC”.

I feel that today’s top officers in all services are confused on the issue.

I read in another article they are simply declaring him as “naive” and he will get no jail time. The Kenyan King has laid down his decree.
