Alan Grayson Threatens Lawsuit on Citizenship Grounds if Ted Cruz Is the GOP Nominee
Breitbart ^ | 25 Nov 2015 | Jeff Poor

...

While discussing Sen. Ted Cruz (R-TX), Grayson told Colmes he didn’t view Cruz as a natural-born citizen and would challenge his candidacy with a lawsuit if he were selected by GOP voters to be the party’s presidential nominee.

Partial transcript as follow (courtesy Fox News Radio):

....

GRAYSON: It's resolved itself into this weird reality show. It's not "The Biggest Loser" that they're choosing, it's "The Biggest Bigot."

COLMES: That's very interesting, are they all bigots?

GRAYSON: Show me one who represents the exception here. In a sense I guess Cruz is not technically that way, because technically he's not even an America.

COLMES: Well, his mother was born here, so I guess like Obama, though it's interesting to me the people who had a problem with Obama, though it's interesting to me that the people who had a problem with Obama's birth certificate don't have a problem with Ted Cruz who literally was born in another country and renounced his Canadian citizenry.

GRAYSON: I don't know … the Constitution says natural-born Americans, so now we're counting Canadians as natural born Americans? How does that work? I'm waiting for the moment that he gets the nomination and then I will file that beautiful lawsuit saying that he's unqualified for the job because he's ineligible.

...

COLMES: Now I wonder, does he qualify because of having an American mother can considered an American citizen and in fact he renounced his Canadian citizenship to be an American citizen, but you’re talking about American birth, but I believe if that’s one of you parents —

GRAYSON: Look, even the anchor babies are actually born here. He doesn’t even meet that qualification.

...

Grayson is ignorant of the Constitution. The only solution for this issue is declared in the 20th Amendment, Section 3, and is in the hands of Congress.

Let us hope Justice Ruth Bader Ginsburg can stay awake long enough to issue an opinion.

Two nutcases trying to have a conversation about something I’m sure they don’t understand.

Grayson! I didn’t think they gave out weekend passes at what ever mental institution they keep him in.

"He should be able to understand the term “de facto.” After 0bama, Cruz is de facto qualified."

I keep hearing that all the time. I don't understand the reasoning. Obama provided documentation of his American birth. Now maybe the documentation was falsified but no precedent was set, since no one of "standing" challenged the documentation.

For standing you need to show that you have been harmed. Further, elections are a political process and the courts have continually punted it back to the politicians. But the cowards in DC refused to go after Obama for fear of being called racist.

I know Asa. So does everyone.

The law was that 0bamas mother was not able to give us citizenship to her baby...hence 0bama could not have been nbc.

Cruz’s mother otoh was able to do so.

That is what you’ve missed. There is a difference in the two moms that you omitted from your analysis.

Separately, it has now been shown that this nbc thing doesn’t matter anymore sadly. Prior to election, there is no standing. After the election, the political process trumps election law.

Grayson is too mentally ill to understand it would be like poking a wasp’s nest with a stick.

I hope that he hires Orly and Larry Layman as attorneys. Oh, and there was a California lawyer named Gary Kreep. That was a real dream team.

“...since no one of “standing” challenged the documentation.”
___

Do you even know what “standing” means? I certainly don’t since no one seemed to have “standing” to challenge 0bama’s eligibility. Therefore, de facto no one has standing to challenge Cruz’s eligibility.

If Grayson files a lawsuit, it will get tossed for lack of standing. To file a federal lawsuit, you have to show that you will personally suffer some type of loss or damage as an individual that is separate from some general impact on the overall population. What loss or injury can Grayson point to that affects him as an individual? None. That is what makes suing in federal court so difficult to do.

Each state has a procedure by witch a candidates name is placed on the ballot. Who ever is in charge of that process would have “standing”. I also think any candidate on a ballot running for the same office would also have standing.

You think he is insane. A liberal judge or a bought or intimidated judge, think Roberts, may have a different appreciation of his charge.
