The women cannot prove their accusations. Bill Cosby can prove that there is no physical evidence that he committed sexual assault. I think he’s got the women dead in his sights and in an unbiased court of law will be destroyed by Cosby.
...but there’s the sealed transcript that apparently wasn’t so sealed where he admitted to doing as many of the women claim.
i think proving no physical evidence exists might be difficult. for example, the evidence might exist but no one has found it yet or someone is holding onto it. you can’t prove a negative.
so it would boil down to he said, she said, except that there are 40 or 50 otherwise seemingly unconnected women who have made allegations. so what is the chance of this happening in real life? if the juries think it is small, then he pays. if this is true, then the countersuit seems like just a legal tactic to wear down the (alleged) victims.
I’m not quite sure that it is SOP in these types of cases but someone out there might know.
Also the women making the allegations might have reason to expect this coming, and be prepared for it.
