Youâd think a law professor would know that the First Amendment, by its very nature, protects speech that is deeply unpopular.
But the interim vice chancellor for inclusion, diversity and equity at the University of Missouri has apparently not brushed up on the Bill of Rights since he took his position this fall.

Finally! Someone who gets it! Our Founding Fathers saw the need for an amendment to the Constitution to protect our right to say things no one finds controversial. Makes perfect sense.
Oh, but the First Amendment DOES permit you to say hateful things. What it does NOT do is protect you from retaliation in like kind, or prosecution for exceeding merely exercise of speech.
Taking the emotions that generated the hateful things in the first place to the next level, physical action, places you in an entirely different plane, and may result in very actionable criminal charges. And there is no requirement, ever, that anybody else has to take what you say seriously.
But what you do can get you in deep doo-doo.
Academia is committing and overdue suicide.
Perhaps, some institutions, like Hillsdale College, dedicated to education will arise from the ashes, while those dedicated to engineering will survive.
That is sad, because as an engineer, I believe that a good engineer needs an underpinning of the traditional, liberal studies. Not the unadulterated crap that has crawled out of the sewers of socialism and communism in the past 50-years.
Yes we must use the force of law to protect the right of the people to say nice things about the left....

The First Amendment of the federal Constitution restricts Congress.
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
Your state constitution is vital too.
“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
The Second Amendment on the other hand applies to all governments in the US.
That is exactly correct. Everyone should, and does have the right to say anything they want. They better be willing to face the consequences though. You call someone the “N-Bomb”, you better be more than willing to at the very least, get your butt kicked. If you yell “fire” in a theater, be prepared to go to jail.
We also have the right to eat or drink anything. If you have the desire to drink gasoline, go for it. There will be reprocussions. Burp.
So what the he!! are “hateful things”?
Who decides that? 3 guys sitting around a room? 3 guys and 3 gals? The whole damn town versus you me and that guy over there?
Thats not law. Thats why there’s a first amendment.

And the Federal Arbitration Act clearly violates the First Amendment in my opinion, but not the Supreme Court’s opinion.

Most higher education will be online within a decade.
Only some teacher prep, nursing and surgery courses really need to be taught on a physical campus.
We can probably move junior and senior high school level education online too.
