Police: Constable serving eviction order kills 12-year-old

DUNCANNON, Pa. (AP) — A constable serving an eviction order at a central Pennsylvania apartment fired at an armed tenant but the bullet passed through the man's arm and fatally struck his 12-year-old daughter, authorities said.

The constable went to the apartment near Duncannon, about 10 miles northwest of Harrisburg, at about 10 a.m. Monday to enforce a district judge's eviction order, state police said Tuesday.

A man answered the door, closed it, then reopened it and exchanged words briefly with the constable, police said. He then pointed a loaded .223-caliber rifle that had been "slung and concealed along his body" at the constable's chest, police said. The girl was standing behind her father, authorities said.

The constable, investigators said, drew his own .40-caliber weapon and fired once, but the bullet went through the man's upper left arm and hit the girl. She was pronounced dead at the scene. Her name wasn't immediately released.

State police said the suspect's rifle was found "with a loaded chamber and a magazine containing 30 rounds."

In Pennsylvania, constables are elected officials with limited law enforcement powers. They serve warrants, transport prisoners and perform other duties for Pennsylvania's district courts, the lowest level of the judiciary.

The man being evicted, Donald Meyer, 57, was flown to Hershey Medical Center for treatment. He is charged with aggravated and simple assault, terroristic threats, and recklessly endangering another person. A phone listed in his name wasn't working Tuesday and court documents don't list an attorney who could respond to the accusations.

Apartment complex employees were at the scene to assist with and witness the eviction and provided statements to investigators, police said.

Sad. What this "father" did was in a way not much diffrent than the Palis in Gaza lobbing rockets in to Israel while they hide behind their own children, so yeah he should bear some culpability in his daughter's death. Was he high, or drunk? Or did he have a meth lab in the apt? Surely the investigation will bear any of it out.

doesn’t this make it father’s fault for his daughter’s death. He pulled a gun on police officer and his daughter died in the crossfire.

Why would someone pull out a loaded chambered rifle, point it at the cop, then not pull the trigger?

Bluffing? Stupid all the way.

If he was not intent on pulling the trigger, should have left it in the closet. Cost him a daughter minimally.

It is winter, and he may have had no place to go.

What a stupid bastard, not only causing his daughter’s death, but laying the guilt for it upon the heart of this constable who was just doing the job of the Court. They LOST their case to the landlord, the constable is not the enemy.

He wasn’t hiding behind his daughter. It was the other way around.

Pull a gun on a cop, and it is usually suicide by cop, unless you are intent on murder. Either way, poor way to get a night's sleep under a roof.

If not prepared to pull the trigger, should NEVER pull the piece.

Most likely doesn't have all the marbles in a row.

Daughter is a high price to pay.

Sad but a hard lesson in respecting the law.

1. There is no homeless shelter?

2. Eviction notices never come as a surprise. Even an emergency eviction has several days notice associated with it. I have had to evict tenants for things like firing a shotgun through the wall and into the adjoining apartment. Even then, no one is put on the street unexpectedly.

3. The only exception ever is a domestic restraining order, which is not an eviction. I have had co-workers where their wife would serve them with a notice to keep out with no prior notice. But that is not an eviction.

So the guy is already pointing an AR at the constable while the constable is reaching and drawing his sidearm, and then pointing and firing it, and the guy doesn't pull the trigger on the rifle?

:sigh: Yet another cop shooting that doesn't make sense. I hate this crap. How about the cop saw the rifle hanging on the sling and then just drew and fired on his own, and hit the girl? That's reality, not someone pointing a rifle at a cop and waiting to be shot.

Exactly, evictions take at least two months. This guy also had his day in court.

The article at Pennlive brings out that this day was known to be coming and that police noted, once inside, that no preparations for moving had been made.

I think the standard choice is either 20 or 30 rounds for an AR, right?

“Are there many 31round mags?”

Chamber a round then replace it in the 30rd magazine. Then you are, as they say, “fully loaded.”

And fully stupid judging by the results this guy got.

Tragic, the absolute stupidity of her father caused her death. I hope he begs on his knees for forgiveness each day of his life until he burns in hell.

Pennsylvania’s laws give a lot of protection to tenants. It’s more difficult to evict in the winter months. I used to own and/or manage a lot of rentals in Central PA.

I know a few constables in this area of Central PA. Most are really great guys but some are real jerks. They didn’t mention the guys name in the article, but there is one constable I know who lives close to Duncanon who is as corrupt as can be. Plus, cocky and aggressive.... It would not surprise me it it was him.
