Tennessee Bill creates owner liability for safety in gun-free zones

This legislation creates owner liability for gun owners who get victimized in a gun free zone.

(b) Any person or entity authorized to post property pursuant to § 39-17-1359 who elects, pursuant to that authority, to prohibit the possession of firearms by a person authorized to carry a handgun pursuant to § 39-17-1351, thereby assumes absolute custodial responsibility for the safety and defense of the permit holder while on the posted property and while on any property the permit holder is required to traverse in order to travel to and from the location where the permit holder's firearm is stored.

(c) The responsibility of the person or entity posting for the safety and defense of the permit holder shall extend to the conduct of other invitees, trespassers, employees of the person or entity, vicious animals, wild animals, and defensible man-made and natural hazards.

(1) Any handgun carry permit holder who is injured, suffers bodily injury or death, incurs economic loss or expense, property damage or any other compensable loss as the result of conduct occurring on property that is posted pursuant to § 39-17-1359, shall have a cause of action against the person or entity posting. In addition to damages, the person shall be entitled to reasonable attorney fees, expert witness costs, and other costs necessary to bring the cause of action.

Correct, I make the decision. It's not my property.

I don't "have" to go into any place that isn't a government building and what I "want" doesn't mean I can trump the rights of the property owner who doesn't want me there. I can find one that will allow me in, just like people wanting gay cupcakes and cookies. It's private property, not mine either.

What if? I chose to be there, unarmed. Bad choice on my part. I should have made better decisions and went elsewhere.

I am, no one else... unless I am a minor child.

I can think of several places you might ‘have’ to visit.

1. The last time we bought a house in the Houston area, even though it was in the Clear Lake area, we had to drive to north Houston, 40 miles away, to the closing, even though the title company had a local office less than two miles away. When I protested and said I wanted to do it at the local office. I was told the closing was in north Houston and if I didn’t show up, the closing and the sale would be cancelled, and I would forfeit my deposit.

So what if I get up there and the office building owner has posted a 30.06 or 30.07 sign?

2. What if the office building where your long-time family lawyer, CPA, or doctor has his office, posts a ‘disarm’ sign?

Do you forfeit your $10,000 deposit, or drop your long-time doctor, accountant, or lawyer?

I agree take away his armed detail and see how he likes living like the commoners. I just remember his anti-gun crap when he was mayor in Knoxville. He is a Jeb Bush Republican liberal.

I hope the legislature overrides a Haslam veto but the Tennessee Republican Party has a lot of libs in it.
