All Congress can do is recommend an indictment to the Justice Department, and the Justice Department as currently constituted will not indict Democrat politicians. Perhaps Gowdy is smart enough to know that if he delays his recommendation until after the election, there is actually a chance an indictment might happen?
The house has Constitutional power to arrest for contempt, and has never once used it.
