Why say anything? Let Obama put his name forward. Consider it until the election is decided. If Hillary wins confirm him. If she loses wait on Trump. Who knows what he will do.

Don’t forget that Justice Kennedy, one of the “Conservatives”, sometimes votes with the liberals. Also, don’t forget that he was elected in a fourth year of a Reagan term, which kind of knocks out the argument that we don’t do that in the final year.

I agree - I’d take Sandoval in a heart beat. Do people here really think Obama would nominate a conservative?
The apointment was in an election year but the nomination process started a year before and was held up by the dems.
I also agree. It’s hard to believe that Obama will actually nominate Sandoval, but if he does we should all cheer him on. Sandoval would protect our gun rights, and would prevent other important Supreme Court decisions from being reversed. Why gamble on the outcome of the November election, which could result in a disastrous Supreme Court nominee if Hillary wins?
Are you a tax-paying resident of Nevada? I am! The man is NOT a conservative. He’s pro-amnesty and runs a sanctuary city here in Las Vegas. We rate 50th in education in the nation. Our schools are overrun with illegals who can’t speak English. He overrode the will of the people and passed the largest tax bill in the state’s history. He should be in Obama’s cabinet, not on the Supreme Court!
There is no way Obama will go through with Sandoval. It is simply a bluff and the GOP should call his bluff by agreeing to Sandoval.
Why not encourage the nomination of Sandoval then delay action until after the election. If a republican is elected, then don't have a confirmation vote and allow the new president to appoint someone. However, if a democrat (Hillary) is elected, immediately confirm him as he would be better than anyone she would send up.
Other people have suggested the same thing, but it wouldn’t work. If Republicans delayed a confirmation vote on Sandoval until after the election, Obama could simply withdraw the nomination.
I think they should have said they would consider it but that they would not hold hearings until after the election. That way if the democrats win the general then they could confirm him but if the republicans won, then they could hold off on confirmation pending a new appointment.
I’m sure Sandoval would be 100 times better than any nomination from Hillary or Sanders.
Obama is the POTUS, and the POTUS picks Justices. He’s not going to pick a conservative. Sandoval isn’t my ideal Justice, but he is degrees of magnitude better than the two he’s picked, or anyone we can expect from Clinton.
If we get Sandoval, the battle for ideological control will be postponed until the Ginsberg vacancy.

That’s a good way of looking at that. Hope for the best but prepare for the worst. I like it.
They could not schedule a vote until after the election. If Hillary wins then vote to confirm. I suppose that could be a PR disaster....
Exactly, it’s a trap. Obama nominates a Republican, the Senate agrees to look at him and he suddenly takes himself out of consideration. The doors then open to Obama’s real choice.
