They can say anything they want.
They just can’t lie knowingly without financial consequences, which right now they can.
He’s not proposing a criminal element or a government suppression.

There are remedies against anyone who abuses a right and causes harm against another person whether it be imprisonment or civil actions in the cases of libel or slander.
