Mississippi Becomes 10th “Constitutional” Carry State; Governor Bryant Signs HB 786

Mississippi became the 9th state to restore permitless carry today, the 15th of April, 2016.  It seems poetic that Governor Bryant chose to sign HB 786 into law a few days before most citizens were required to file their federal taxes. The easing of one burden helps reduce the pain of another, in this case.  HB 786 is titled the “Church Protection Act”, which is a correct description.  The bill provides that churches can create volunteer church security that will have the same protections that private security guards now have in Mississippi.  The program will require training and the designation of the volunteers in writing.

The permitless carry portion of the bill was an amendment that made a small, incremental change to Mississippi law.  Last year, in 2015, the legislature changed the law to allow people to carry concealed firearms in purses, bags, cases, briefcases, and other fully enclosed case, without a permit.  This year the amendment to HB 786 added pistols or revolvers carried in a “sheath, belt holster or shoulder holster”.  There is not much left.  From HB 786, as it was sent to Governor Bryant.  Underlined words have been added to the statute by the bill:

(24) * * *  A license * * * under this section is not required for a loaded or unloaded pistol or revolver to be carried upon the person in a sheath, belt holster or shoulder holster or in a purse, handbag, satchel, other similar bag or briefcase or fully enclosed case if the person is not engaged in criminal activity other than a misdemeanor traffic offense, is not otherwise prohibited from possessing a pistol or revolver under state or federal law, and is not in a location prohibited under subsection (13)

99 and 44/100ths constitutional carry your out of luck if you can’t afford a holster or bag of some sort.

No, it’s 100% Constitutional carry. LAST year there was a bill that allowed carry in a purse, briefcase or other container that could be completely closed but the bill signed today allows for you to carry concealed, open, or if you’d like you can light them on fire and juggle them through the town square. Also as an added benefit, it becomes effective today! Load your pockets boys!

I believe it is not quite Constitutional carry.

Carrying a pistol in your pocket without a sheath or holster still seems illegal, for example.

But 99 & 44/100% is darn close!

Honestly, I have no idea how “Shall Issue” ever passed.

I remember that - every cliche was dragged out in an attempt to stampede the people against it. It got so bad, I wrote one hand-wringing reporter an email paraphrasing the Five Stage of Accepting Death with Shall Issue, using headlines over the past few months for each stage.

She admitted it was clever, but that "it would never pass". I promised her that a year later she'd either be reading or writing an article along the lines of "Gee, nothing like that happened" - the same as experiences by all the other states and their anti-gun Media.

A year later, I forwarded her an article along that same line by her own newspaper and asked for a comment. Never heard a word.

Simple enough. We organized, fund-raised, campaigned. We volunteered for the candidates who supported us, talked to the candidates who were on the fence, etc.

It’s called politicking.

It all started when Joe Olson decided to do something, printed up some flyers, and headed out to a gun show.

(This is, by the way, the anti’s are so adamantly opposed to gun shows - they hate that gun owners have venues where they can get together and talk about things.)
