The nation's foremost Latino civil rights organization is suing a cemetery association in South Texas because a widow alleges the caretaker refused to take her husband's ashes because he was Mexican.
The Mexican American Legal Defense and Educational Fund (MALDEF) has filed a lawsuit on behalf of the American G.I. Forum of Texas, which alleges the Normanna Cemetery Association has historically been a "Whites Only" cemetery, turning away Latino and African American requests for decades.

If it is, and civil rights under the law remain with you after death, the cemetery is going to lose.

I find this hard to believe it being 2 hours from the Mexican border. Is she trying to start something using her dead husband’s ashes? Ashes usually aren’t buried in cemeteries. Is this even what he wanted? She could easily just scatter them when the caretaker wasn’t around. Her story smells.

That’s not exactly correct. If it were a privately owned apartment complex, they could not refuse a customer based their being Hispanic.
Obviously, the difference here is that the prospective tenant is dead.

Unless it’s a family-only cemetery (private property where relatives bury their own) they will probably lose the case.
I think how most cemeteries work is you actually have a deed for the plot you purchase, or you have a lease if it’s rented (not sure how an eviction would work there!).
In other words, it’s a land transaction and therefore falls under the jurisdiction of the Civil Rights Act of 1866.
That act wasn’t always followed, however, and various cases ultimately resulted in what we have today - no racial discrimination in the sale or rental of publicly or privately held property. Race includes ethnic traits such as, national origin, language, etc..
Cases of note if you want to google/research:
Plessy v. Ferguson 1896, upheld segregation.
Brown v. Board of Education 1954, overturned Plessy.
Jones v. Mayer 1968, found constitutional basis for 1866 Act.
Of course, as long as no one sues you, you can pretty much do what you want which is probably why this particular cemetery has been getting away with it.

Not quite. My parents and in-laws’ cremains are buried in cemeteries. Arlington National Cemetery has a very large vault for cremains. Some people choose to scatter the ashes; others bury the cremains in the ground as they would a coffin.
