Transgender Activism Has Produced a Legal Absurdity
National Review ^ | May 10, 2016 | Ed Whelan

Posted on 05/10/2016 4:51:04 AM PDT by reaganaut1

In a 2–1 panel ruling in mid April, a federal appellate court decided (or at least seemed to think that it decided) that G.G., a girl who identifies herself as male, has a legal right to use the boys’ restrooms at her high school in rural Gloucester County, Va. In so doing, the panel’s majority, consisting of two appointees of President Obama, kowtowed to the Obama administration’s radical claim that federal law requires any college or school that receives federal funding to make its single-sex restrooms, locker rooms, showers, housing, and sports teams available to “transgender students consistent with their gender identity.”

Never has a more brazen and aggressive bureaucratic misreading of federal law encountered a more craven and confused judicial reception.

In 1972, Congress enacted the federal law known as Title IX. Title IX provides generally that no school that receives federal funding — a category that includes public grade schools and high schools as well as nearly all colleges, public or private — may “discriminat[e]” “on the basis of sex.” Everyone understood from the beginning, and the Obama administration still agrees, that Title IX allows schools to have single-sex restrooms, locker rooms, and showers. A regulation dating from 1975 says exactly that — a school “may provide separate toilet, locker room, and shower facilities on the basis of sex” — and goes on to specify only that “such facilities provided for students of one sex shall be comparable to such facilities provided for students of the other sex” (emphasis added).

“Obama administration’s radical claim that federal law requires any college or school that receives federal funding to make its single-sex restrooms, locker rooms, showers, housing, and sports teams available to “transgender students consistent with their gender identity.”...........

Next thing we hear, those same schools will be required to have separate teams for the “transgendered”. This whole country has become insane under Odumbo. We need Trump.

It’s time for the guys in Gloucester County to hold it in until recess and find a bush to do their business. Let’s see her try that one.

Here are the 20 Republican turncoats who voted in favor of cloture for the nomination of Loretta Lynch. Since it takes 60 Senators to vote for cloture, if only 7 of these 20 turncoats voted against cloture, the nomination of Loretta Lynch would have died:

Alexander (R-TN), Ayotte (R-NH), Burr (R-NC), Capito (R-WV), Cochran (R-MS), Collins (R-ME), Corker (R-TN), Cornyn (R-TX), Flake (R-AZ), Gardner (R-CO), Graham (R-SC), Hatch (R-UT), Johnson (R-WI), Kirk (R-IL), McConnell (R-KY), Portman (R-OH), Roberts (R-KS), Rounds (R-SD), Thune (R-SD), Tillis (R-NC)

Donald Trump Has Words for Transgender Miss Universe Contestant
April 4, 2012
By KATIE KINDELANKatie Kindelan More from Katie » via GOOD MORNING AMERICA

“I think Jenna should focus on running up in Canada and seeing how she does in Canada and then, if she does well, she has a chance to become what many, many young women all over the world want to be and that’s Miss Universe,” Trump, whose company owns the Miss Universe and Miss USA pageants, said today on “ Good Morning America.”

...”The fact is we went by the laws of the country and the laws are very clear and, based on that, about two days ago, we decided to let her compete,” he said of his organization’s decision.

...”We’ll probably have to open it up … because if it’s in Canada and if it’s in the United States, in terms of their laws, and if other countries don’t necessarily have those laws, it wouldn’t be fair just to take certain countries,” he said. “So we’ll probably decide - we haven’t made that decision yet - but we’ll probably decide to open it up.”

...”We’re going by the laws of Canada and the laws of the United States and they’re really very clear,” Trump said. “I hope she does well.”

The law doesn’t say, “based on their CHOSEN sex”, as at the time the law was passed, it was asummed that “sex” implied that to which you were born.

It is absurd, to the nth degree.

The country, and the world is falling apart, and we are wallowing in bathroom rules for those who pretend to be another sex. These gender-benders are all about special rights, and perversion. It seems the emphasis has been placed on males using the female bathrooms and locker rooms. What could possibly go wrong?

Obama is using mafia style to push this agenda while on his way out. His sophomoric mentality and obvious intent to wreck America as he departs smacks of the childish morons who wrecked the White House as the clintons left it.

What’s next? Removing all the “T’s” from the keyboards? Stealing the China?

The worst thing we’ve done is electing these rebellious 60’s hippies into public office.

As someone here mentioned yesterday this is an easy fix.

NC sends a reply that states they do not identify as NC any longer.

The sad thing about this is Gender Dysphoria is a mental condition. G.G. needs help and as a 13 year old biological female, she isn’t going to find it in the boys locker room.

Hmmm....under this trans-stuff, couldn’t a guy who resides in Alabama be trans-NC or trans-SC or trans-TX? Couldn’t I just identify myself no longer as an Alabamian but as a Texan?

I hate suggesting to take this all to the next level, but it seems to me that just using the sexual nature of trans...is simply one single case. I could identify myself as Trans-French, or Trans-Catholic, or Trans-Umber (from House of Thrones).

Soon the boys will figure out that while they are not good enough to make the male baseball or basketball team, they are easily better than the members of the female team.

Since it’s usually liberal legal to discriminate against males it will be interesting to see the verbal gymnastics the libs will employ to protect women’s sports from takeover by men.

a school “may provide separate toilet, locker room, and shower facilities on the basis of sex”

The word sex is now only to be used to describe behaviour depicted in PG-13 movies on up.

Everything is "gender" now.

Un-cowered men should welcome the transgendered female into their “potty-place” and immediately start exposing and “slinging” their manhood at s/he/it (a nice construct, no?). For each person, take it up on your own and then, in Clintonian fashion...deny, deny, deny.

“Wiggle-the-wang” at the transgendered and then ask the local administrator to provide proof outside of hearsay.

You will only see the extremists resisting this stupidity once men start pretending to be women to gain scholarships reserved for (born) women athletes. Guys who aren’t good enough to make a college men’s team will recognize they are actually better players than most female athletes. They will realize that by simply reclassifying themselves as an alternate sex (free for the taking), they will gain access. Colleges will face lawsuits based on these same foundations of sand they are using now. I expect basketball will be the first to fall.

I wonder if most/any blacks are offended by Loretta invoking Jim Crow laws to justify why the US Dept of Just Us is going after NC for gender potty rights.

Ayotte and Portman are both up for re-election. Methinks a President Trump will have to put together a coalition across the political spectrum. Those two don't deserve to be re-elected.

I've been thinking about this bathroom situation. For girls who are in difficult or abusive sexual environments, not having privacy in the bathroom must be horrific. Besides that, I'd think there must be some problems with religious groups. Are Nuns, Muslim and Quaker young ladies (as examples) permitted to share a bathroom with men?
