If the Democrats attempt to insert Biden they will enrage the Bernie supporters. Bernie's people will rightly object to the Democrats pushing someone who did not participate in the primaries.
Hillary is in until she is either dead or convicted. I don't think an indictment will stop her (right wing conspiracy, politically motivated, innocent misunderstanding, no criminal intent).
I don't believe there will be an indictment in the first place. But if by some miracle there is one, she'll have a hard time arguing that the Obama DOJ is part of a politically motivated right wing conspiracy.
In fact, it's because Obama's DOJ is so partisan and leftwing that I don't think an indictment will happen.
There are not good options or good outcomes for the democrats this year. All the democrats have is bluster and pretense.

Of course, if the GOP had nominated one of the expected bunch (like Jeb) then the Dems probably wouldn’t care if the GOP won the White House. As we’ve learned this cycle, the uniparty is real.
