Everything is situational. If the accused is a member of a protected class (privileged, minority, elected, appointed, anointed) then waivers and due process are the rule.
For the rest, as long as you aren't incarcerated, you are free. Being on a watch list isn't a conviction or even an accusation. You just can't possess a gun.
