The White House on Monday defended President Obama’s decision to enter into the Paris climate accord without Senate ratification but stopped short of confirming a Chinese report that he will do so this week during his trip to China.
Still, it would surprise no one if Mr. Obama and Chinese President Xi Jinping were to announce the ratification of the sweeping climate change agreement before the Sunday opening of the Group of 20 summit in Hangzhou, Zhejiang.
White House senior adviser Brian Deese said the president has the legal authority to ratify the accord without the two-thirds Senate vote required for treaties. He said the pact negotiated by 195 countries in December is merely an “executive agreement.”
“The president will use his authority that has been used in dozens of executive agreements in the past to join and formally deposit our instrument of acceptance, and therefore put our country as a party to the Paris Agreement,” Mr. Deese said at a White House press conference.
He noted that both presidents announced in March that they “would seek to formally join the Paris Agreement in 2016.”
“That’s a process that is quite well-established in our existing legal system and in the context of international agreements and international arrangements,” Mr. Deese said. “There is a category of them that are treaties that require advice and consent from the Senate, but there’s a broad category of executive agreements where the executive can enter into those agreements without that advice and consent.”

His deal does not bear the weight and authority of a duly Senate-ratified treaty/pact and it isn’t worth the paper it’s printed on beyond his administration’s tenure.
Just wait until President Trump takes office, they will be besides themselves...

The senate has time and again neglected to check Obama’s abuses. Of course, this just invites him to grab for more and more power and to bypass them with no consequences.
The senate has failed to perform its responsibilities under the Constitution. They all need to get the boot.

The first person this “executive agreement” personally affects negatively may sue, and almost certainly successfully.
The Democrats will never allow Trump to get away with half of what Obama does. They will spring into action, assisted by their fellow travelers and allies in the media, to block Trump’s every move. They will stop at nothing to stop him.
The only thing I admire about Democrats is that, unlike Republicans, they play to win.
Unfortunately for Trump, he will also have to fight against elements in his own party. He’s going to have his hands full.

I take your point. It does occur to me, though, that the attention this is getting might net Mr. Trump some votes.
Uh, isn’t the White House n0bama? Isn’t that the same as the manchild saying, “I approve of this nonsense?”
He can SAY he ratified it all by hisself, but that does not make it so.
It's like Obama's "do not deport" policy. It takes cooperation to enforce it.
It has ZERO force of law.
I, personally, will call the EPA, and will instruct them exactly how, when, and where I will be violating the terms of this unratified garbage.

Ther accord says that these countries now have to go back to their legislatures to ratify it.
Where is the Senate response?
