The White House on Monday defended President Obamas decision to enter into the Paris climate accord without Senate ratification but stopped short of confirming a Chinese report that he will do so this week during his trip to China.
Still, it would surprise no one if Mr. Obama and Chinese President Xi Jinping were to announce the ratification of the sweeping climate change agreement before the Sunday opening of the Group of 20 summit in Hangzhou, Zhejiang.
White House senior adviser Brian Deese said the president has the legal authority to ratify the accord without the two-thirds Senate vote required for treaties. He said the pact negotiated by 195 countries in December is merely an executive agreement.
The president will use his authority that has been used in dozens of executive agreements in the past to join and formally deposit our instrument of acceptance, and therefore put our country as a party to the Paris Agreement, Mr. Deese said at a White House press conference.
He noted that both presidents announced in March that they would seek to formally join the Paris Agreement in 2016.
Thats a process that is quite well-established in our existing legal system and in the context of international agreements and international arrangements, Mr. Deese said. There is a category of them that are treaties that require advice and consent from the Senate, but theres a broad category of executive agreements where the executive can enter into those agreements without that advice and consent.

Executive agreement? Trump can rescind it the minute he takes office Barky. And it isn’t a treaty no matter what foreign countries think....not without a Senate approval.
Oh, and the world is well aware of the US Senate requirement. A-hole.
“Colin Kaepernick sitting is the most important topic of the month...”
I learned how to walk AND chew gum!
Typical Trump will blow it back in their faces with “You didn’t complain when Obama was issuing executive orders.”
Put the abolition of this on the ever-increasing “To DO List” on Donald’s first day in office.
Rather than attempt to unravel all of the “Lyin’ King’s” tangled web, Donald should just employ the “Gordian Knot” Technique.
“We need a military coup. “
The military isn’t trustworthy today. There is not a single General today who I would trust with the reigns of power. At best you could expect the childlike life of a military base for the whole nation.
Useful Idiots like Kaepwhatisname come in handy when "statesmen" step in big piles of dog doo...

The president signing an agreement without authority has the same worth as if you or I signed it. Nether you or I have such authority either.
RIGHT! What can be "ratified" by executive order can be unratified by executive order.
If he directs the EPA to issue and enforce regs to fulfill the terms of the agreement, are those regs enfoceable in court?
You really have to do a lot of reading to find out that this document is a worthless piece of political cr**.
Senate gives him everything he wants anyway.
The president is just cutting out the empty song and dance.
We will be in that agreement for approximately six months.
They are laying low because the Senate leaders are actually for this, and they want Bath House to take the heat, not themselves. Its all about fooling the rubes back home.
He says it is an agreement not a treaty
executive agreement
executive action
Just more nonsense with no force of law.
El Presidente has all the power he isn’t denied.
Every usurpation and act of tyranny establishes precedent.
We shall elect a despot in November. Perhaps follow-on despots will, like Venezuelan presidents, rely on elections to claim unlimited mandates from the people. So, in despotic nations, elections are pro-forma but necessary courtesies in which the outcome is known, yet the whole process has to have the aura of legitimacy.
If the immensely popular Trump magically loses, we’ll positively know that we’ve crossed the line into banana republic despotism. No rat will subsequently ever lose another “election.”
If it’s an executive agreement then it only applies to the executive who signed it. Let’s assign a squad of Marines to Obuma to be certain he abides to the agreement.
First, assign a shack for Obuma to live in. A 15 watt bulb for light and heat. Two chickens, one for eating, the other for eggs. A bag of seeds to grow beans. An old tire to fashion shoes.
That's OK.
Trump just needs to publish a change to it by EO.
Then they either have to agree to EO’s or define Trump's actions as illegal.
Put the (D)’s and the MSM in a Catch 22 situation...:^)
The GOP eunuchs need to be simply stating, “NULL AND VOID!”
Is there anything they don’t defend him on?
