The headline is misleading.

The emails read about Obama applying political pressure on Roberts, saying that the Supreme Court will lose popular political support if they do not uphold obamacare.

There is no physical threat mentioned.

Roberts has certainly lost PPS anyway. Seems like he has been keeping his head down for quite a while now. The media has not yet done their annual story about Roberts’ exiciting Summer Vacation.

All true.

What I don't understand is why a Chief Justice could be swayed by caring about "popular political support". Everything about the Court is set up so that this is a non-issue. They decide what they think is best and the hell with everything else.

And yet Roberts clearly acted as a political puppet. Why?

As far as I know, no documentation of any physical threat has been revealed at this time. But I think there must have been such a thing.

Nevertheless, it is improper to make extrajudicial statements, regardless of “intent” or “persuasion” That’s what the lawyers were for.

If Roberts discussed the ongoing case with Obama privately, that is a serious ethical violation on Roberts part. He can be impeached. Ex parte activity is a clear violation.
