FBI in Internal Feud Over Hillary Clinton Probe (McCabe notified in early October)

The latest development began in early October when New York-based FBI officials notified Andrew McCabe, the bureau’s second-in-command, that while investigating Mr. Weiner for possibly sending sexually charged messages to a minor, they had recovered a laptop with 650,000 emails. Many, they said, were from the accounts of Ms. Abedin, according to people familiar with the matter.

Those emails stretched back years, these people said, and were on a laptop that both Mr. Weiner and Ms. Abedin used and that hadn’t previously come up in the Clinton email probe. Ms. Abedin said in late August that the couple were separating.

At a meeting early last week of senior Justice Department and FBI officials, a member of the department’s senior national-security staff asked for an update on the Weiner laptop, the people familiar with the matter said. At that point, officials realized that no one had acted to obtain a warrant, these people said.

Mr. McCabe then instructed the email investigators to talk to the Weiner investigators and see whether the laptop’s contents could be relevant to the Clinton email probe, these people said. After the investigators spoke, the agents agreed it was potentially relevant.

Others further down the FBI chain of command, however, said agents were given a much starker instruction on the case: “Stand down.” When agents questioned why they weren’t allowed to take more aggressive steps, they said they were told the order had come from the deputy director—Mr. McCabe.

Others familiar with the matter deny Mr. McCabe or any other senior FBI official gave such a stand-down instruction.

They are grasping at straws. Nothing I’ve seen here is a fourth amendment matter as long as the PD lawfully had the info.

Someone suggested earlier that Huma had used Outlook Anywhere to connect to Clinton's server.

If that happened, it would have downloaded EVERYTHING in her account into a local cache on the desktop/laptop.

That's the only way I can believe that 650,000 emails ended up on her computer. She set it up (or someone set it up for her), and left it connected to a high-speed internet line.

It would have downloaded her entire email account in the background. The efforts to "clean" Hillary's account in preparation for releasing the emails to State wouldn't have affected Huma's account.

There's also another possibility: someone got illicit access to the laptop/desktop -- allowing them to make a copy. It would be epic if that ends up on Wikileaks.

McCabe has got to stay out of this. He and his wife received way too much money from the Clintoon Crime Family Syndicate. He needs to resign.

McAbe should be recused from any further involvement with this case. He is ethically compromised. If he doesn’t then it’s clear the fix is still in.

Yeah, wow. Looks like the FBI is a big mess. And 650,000 emails? That's insane. I get lots of spam, up to 20,000 a month, but I don't keep those, and mostly am unaware of them. They get filtered to a SPAM folder that I rarely look at, and after 6 weeks, they roll off, gone.

DOJ will attempt that dodge, but it's moot:

a) The laptop was voluntarily surrendered. Under consent doctrine no further warrant is required. The Exclusionary Rule only protects against unreasonable searches. No serious person would accept that reading emails on a voluntarily surrendered laptop would constitute anything "unreasonable."

b) Under plain view doctrine, in most US circuits, all of the emails on the laptop fall under the original sexting warrant anyway.

c) there is no evidence that the new emails have been examined in depth. When an initial warrant leads to the discovery of additional material, the evidence obtained by a second warrant that covers the new material is NOT considered tainted. All the FBI needs to do is obtain a second warrant. It's usual for DOJ to do that, but under US code the agents can submit an affidavit directly to the court, and plenty of them (including Comey) are lawyers.

d) The mere presence, without further in-depth examination of any of these emails is prima facia evidence that Huma lied in her assertion that none of her other devices contained work-related emails. This violates her immunity deal, and she must now testify under oath against Hillary and all of her other criminal accessories.

e) wikileaks already has all the Clinton emails.

f) The court of public opinion is not going to let a Presidential candidate escape on a technicality.
