Federal Water Rights Threaten Local Wells

If the federal water rights sought by the Bureau of Land Management for the San Pedro subwatershed are granted by an Arizona court, existing residential wells near the river could be shut down and real estate development would be stopped, Cochise County Supervisor Pat Call said in a Herald/Review interview.

Paid subscription required to view entire article, here are the specifics. I, along with possibly thousands of other people stand to loose our well water, leaving our land without value.

The case is part of the four decades long Gila River water rights adjudication and has been “activated” for trial proceedings in a Maricopa Superior Court for three weeks in November 2017.

“If the DOJ is successful here, the BLM said 4 years ago at an Upper San Pedro Partnership meeting that if they get their federal reserved water rights they will begin shutting down an residential wells installed since 1988” Call said.

“We’re kind of the test case, but after us, this will move all over the state deciding water rights for federal agencies for other tributaries that are part of the Gila River” Call said.

The BLM is yet another federal office to have taken on the ‘RATS & progressives’ mission of impeding the American economy and, where possible, destroying productive Americans’ lives. Have no doubt of that!

The feds have NO constitutional water rights. The feds are unconstitutional poachers of state lands and need to be KICKED OUT. There is only ONE constitutional excuse for the feds to own land in a state and the requirements for federal ownership are in Art I, Sec 8, Cl 17 of the Constitution (needful military land for buildings for national defense).

Don't forget, the ONLY legitimate power of the feds is that granted by the Constitution. If it isn't a power delegated and enumerated by the Constitution, it doesn't belong to the feds.

KICK THE FEDS OUT!!!

This, along with a myriad of BLM power play lawsuits need to be shut down by Trump. Another “Day One” move. Just have our new AG call off his lawyers (and for good measure, fire them). Any lawyer who would prosecute a case like this needs to be out of the government permanently.

See Agenda 21 at the UN website. They want control of all natural resources, and meters on all wells. Our government is still carrying out the UN’s orders.

Not directly, but “Call said an attorney has been retained but the City of Sierra Vista, Pueblo del Sol and Liberty Water Company to join in contesting the BLMs water rights request. Call, who is the former Executive Director of the Cochise Water Project, said Cochise County Supervisors may consider sharing in the legal costs to oppose the federal agency’s request.”

Further information:

The Salt River Project which provides water to most of Phoenix area supports the federal government rights request. The SRP is a federal reclamation project, which awards federal water rights to the agency.

“The SVP wants the federal government to get the water rights it wants, because that decision would help them secure the water rights in the northern part of the state like the Verde area” Call said.

Not giving legal advice here, but it usually a mistake to let an issue that has direct impact on you go to court without a lawyer representing your specific interest(s).

Draconian, current wells should be grandfathered. They probably expected to negotiate that to placate resistance, which may be more than liberal groupthink thought. I hope you are sucsessful in court.

Do some research and see what local attorneys have been dealing with the BLM previously. Check what their win / lose records are.

The courts can’t grant squat. Courts issue opinions, nothing more. Court opinions are just that - opinions. If landowners can’t exert their private property rights over courts, then expect the government jackboot on your throats forever. If you don’t know how to deal with this judicial, fascist crap, look up “committees of safety.” Then act.
