Neil Gorsuch and the State’s Power to Kill (BARF)

It’s not entirely fair to judge a Supreme Court justice based on his first vote. Urgent matters arise unexpectedly, and the court must sometimes act quickly.

Still, it’s worth paying special attention to Justice Neil Gorsuch’s vote late Thursday night to deny a stay of execution for Ledell Lee, an Arkansas man who was sentenced to death in 1995 for murdering a woman named Debra Reese with a tire thumper.

After Justice Gorsuch, along with the four other conservative justices, denied his final appeal without explanation, Mr. Lee, who maintained his innocence until the end, was executed by lethal injection.

He was pronounced dead at 11:56 p.m. Central Daylight Time, minutes before his death warrant expired. Arkansas had not executed anyone since 2005.

Like the victims relative said this morning, why did we have to live with this for 20 years for justice to close the book.

Facts of the Crime:

Sentenced to death on October 16, 1995 for the February 9, 1993 beating and strangling death of Debra Reese, 26, in the Sunnyside addition, where he had attacked several other women. He was also convicted of raping two Jacksonville women and was tried for the murder of Christine Lewis, daughter of the late Alderman Robert Lewis. Lee was also suspected of killing a Jacksonville prostitute and dumping her body in a shed near the railroad tracks.

Lewis, 22, was abducted from her Sunnyside home in November 1989 as her three-year-old child watched. She was raped and strangled and her body dumped in the closet of an abandoned home. The jury could not agree on a verdict in that trial, but prosecutors decided not to retry him when he received the death sentence in the Reese case and was convicted for raping two women. DNA evidence tied Lee to the murders and rapes. Reese was struck 36 times with a tire tool her husband gave her for protection while he was out of town on a truck driving job. Lee, who had just been paroled after serving time for burglary, was arrested an hour after the murder when witnesses reported seeing him walking the street.

Yet we will do it anyway, even though four other justices voted the same way.

The dude “maintained his innocence”? Oh cool, I guess we shoulda let him out then.

An American chemical company needs to step up and create an effective drug to replace the one the eurotrash stopped selling.

Or alternatively we could just go back to hanging and drop this pretense of poison being more “humane”.

Based on this decision, he’s obviously the right person for the job.

What is wrong with the four justices who sided with the killer? Seriously, they need to butch up and serve society. No matter how squeamish are.

Trust the Times to hit Justice Gorsuch on this. By voting this way, he was simply deferring to Arkansas state law that sanctions capital punishment. And you can even say he was respecting SCOTUS precedent that time and again has upheld the constitutionality of the death penalty.

But Mr. Gorsuch should know that he owes the liberals absolutely nothing. For no good reason, the Dems tried to filibuster his nomination and overwhelmingly voted against him - in spite of the fact that he was very moderate in his hearings.

And the cheapshot the Times took against Justice Gorsuch by saying that his seat should be held by Garland is foolish. By that logic, you could say that the Republican filibuster against many of Obama’s lower court appointments should have stood up. Instead, they were nullified by Harry Reid who nuked the filibuster. The Senate has gotten so partisan that these things now happen on a regular basis. Garland does NOT belong on SCOTUS.

But left the other “four other conservative justices” alone by not naming them.

Personally, I’d prefer that we went back to firing squads. A lot quicker than hanging, and it works irrespective of how fat the felon gets.

I know this is not an uncommon length of time for someone to spend on death row. Perhaps some legal types here could explain how it can take 20 years to exhaust appeals. This is ridiculous.
