Power Move: Gorsuch Opts Out Of High Court Labor Pool

In an early show of independence, Justice Neil Gorsuch declined to join the Supreme Court’s “cert pool,” an administrative division of labor that allows for efficient review of the deluge of petitions the justices receive each term.

On the other hand, it may simply reflect a preference for the work product of his own clerks, an inclination shared by other federal judges including Judge Alex Kozinski of the 9th U.S. Circuit Court of Appeals. He may also feel that opting out of the pool ensures greater scrutiny is given to each petition.

The decision also suggests Gorsuch might share the concerns of many court-watchers and legal scholars who have criticized the pool.

I had no idea they were allowing clerks to review & recommend cases to the justices. I would've assumed a panel of the justices themselves to review these cases.

Inner workings are corrupt. With the partisan nature of the court in stopping baby’s heartbeat and the clearly racist leanings of the self proclaimed Latina.. it’s no wonder justice is not blind.
Never knew about this part of the process.

It looks like this way, Gorsuch gets to see ALL the possibilities for cert. And he will pick his own.

Here is another area the progressive-Left deep state operates, which is not in either the elected or appointed positions of government in any branch, but behind them.

By opting out of the cert pool, as Roberts did not, Gorsuch is keeping HIS review of incoming petitions to the court done by his staff and his staff alone, not influenced by the “cert pool” stacked with Liberals/Progressives/Leftists.

The liberal judges are going to hate this. As it is now, the clerks have way too much discretion to recommend or deny cases to the USSC. Gorsuch will be able to screen partisan cases which might otherwise be advanced by leftist clerks, and recommend cases which actually benefit the people in general.

It says the practice was introduced in 1973 by Burger. The great liberal Burger court...

There are 8,000 cases a year submitted to the Supreme Court. There is no way the justices could read all of the appeals orders and opinions. The clerks read and summarize them. They then probably write a paragraph or two as to accept or reject.

They then put the rejects in one pile and the accepts in a smaller pile for the justices to review. The clerks are doing their clerks job and the justices ate doing.
