Incorrect.

The 1st Amendment already invalidates the Johnson amendment.

The Executive Order does not roll back the Johnson Amendment. Per the Constitution, that would require a bill passed by Congress and signed by the President. - Carl Vehse
Incorrect.

The 1st Amendment already invalidates the Johnson amendment.

Hear, hear! But of course, there can’t be a test case of that if Trump doesn’t enforce the Johnson Amendment.

. . . so it would be proper to push repeal in Congress, while the tax code is being amended to cut income tax rates.
