Excuse me...but isn't the president, in actual fact, the chief prosecutor?

In all the Comey brouhaha beating on our senses is an organizational issue that none of the pundits seems to have picked up on: the simple fact that Donald Trump was really and truly James Comey's boss. The media and the urban elites seem perfectly happy to grant James Comey and the federal attorney general the unlimited power of making a determination of prosecution for any suspected federal wrongdoing. If a high-profile case gets killed in Comey's office or the attorney general's office, there may be some blowback in the media and the general population, but no one ever challenges the legal authority of either the director of the FBI or the attorney general to make such prosecutorial decisions

Well, if DJT actually is the chief prosecutor, that would make 6 equal branches of government. Or something. Maybe we could ask a calibfornia congress critter. They'd know. Many other items the lib/socialist/commies ignore about this "hole" overblown pile of garbage. "Meet the new boss, NOT same as the old boss." Collusion? Where's the statute? Firing people who work for you? Uh, yeah. Putting an end to investigations? Can do. Proof of violations? Not yet but they'll keep looking as long as it takes for something to turn up.

Exactly!

Trump was lawfully elected by American citizens to be the Chief Executive Officer of the Justice Department.

Trump also has the executive power to pardon anyone, including himself.

They keep trying to make a big deal out of a boss and his key officer having a private conversation.

If you can’t have this kind of conversation, because one or the other party isn’t trustworthy enough, then this is a problem.

And, as it turned out, Comey wasn’t the kind of guy you can trust with such a conversation. That by itself is reason to replace him with someone you can trust.

Constitution, Article II, Section 3, listing the duties of the President, includes “he shall take Care that the Laws be faithfully executed”.

It is a listed constitutional duty of the President to have responsibility for ensuring the enforcement of federal law.

Constitutional expert and famed Harvard law Professor, Alan Dershowitz, took on Jeffrey Toobin to discuss the ongoing Trump-Comey saga, saying in no uncertain terms that “this is not obstruction of justice.”

He explains, “That is his constitutional power. He has the right to say, ‘You will not investigate Flynn.’ The best proof of that is he could have simply said to Comey, ‘Stop the investigation, I’ve just pardoned Flynn.’”

To back up his assertions, Dershowitz reminded viewers of when Bush I pardoned Casper Weinberger the night before trial. After doing so, no one cried ‘obstruction’ because it was within the rights of the President of the United States to do so.

“That’s what President Bush did,” Dershowitz said, citing the case of Caspar Weinberger. “You cannot have obstruction of justice when the president exercises his constitutional authority to pardon, his constitutional authority to fire the director of the FBI, or his constitutional authority to tell the director of the FBI who to prosecute and who not to prosecute.”

He made the point that impeachment and obstruction are two entirely different things, which reduced Jeffrey Toobin to look like an 11th grade history student learning the constitution for the first time. The President can be impeached for all manners of things, but not for firing Comey and/or asking him to stop investigating Flynn — because it is his right to do so.

“You can impeach him if you don’t like what he did,” he said. “But you cannot say it’s a crime. It’s simply not a crime for the president to exercise his constitutional authority to pardon or to direct the FBI.”

President Trump is also commander in chief of the armed forces.
I was amazed at the arrogance of comey, back when still in charge of fbi, demanded President Trump go through fbi subordinates to set up a meeting with him.

Yes. While I am not ordinarily a fan of Dershowitz, his point here is eminently sound. Here is what I posted in a couple of threads earlier today:

To really put the implied Comey rationalization--that he was trying to protect the institution from improper pressure from the President--into perspective, one must recognize the obvious, incontrovertible fact: As President, Donald Trump could pardon General Flynn for any infraction--just as Gerald Ford pardoned Richard Nixon; just as Clinton & Obama pardoned people who most of us would have allowed to rot. (I am not suggesting in any way that Ford was not right to pardon Richard Nixon. I certainly would have done the same.)

Viewed in the context of this reality, there is no rational reason to view an expression of "hope" from the President, on behalf of General Flynn, as anything more serious than a frank courtesy to Comey. That Comey--who admitted to being intimidated by Loretta Lynch!--saw it as some sort of threat, is a sorry commentary on Comey, not the President.

Conservative activists should point out the key factor--the absolute right of the President to pardon--at every opportunity, until those trying to make a mountain out of a courtesy crawl back under their rocks!

Alan, reminds me of the smart old style Democrats, I grew up knowing and being around.

They would try their best to beat your candidates in elections.

They still were loyal to America and believed in working for a living.

Alan knows more about our constitution than the entire rat congress and the Obama thugs.

Comey proudly proclaims that he is independent of the CIC.

That is what Blam and some of us are trying to do with Alan’s clear and concise remarks. I posted some of his remarks yesterday. This article explains the reality very well.

“The executive power shall be vested in a President of the United States of America.” (Article II, Section I)

The President [Trump] is the only guy mentioned. This section has not been amended.
