Gorsuch dissents from Ginsburg in case on federal worker complaints

Supreme Court Justice Neil Gorsuch dissented from Justice Ruth Bader Ginsburg's Friday ruling that resolved a dispute over the judicial review procedure for complaints filed by federal employees.

The Supreme Court's 7-2 decision authored by Ginsburg reversed the D.C. Circuit Court of Appeals decision in Perry v. Merit Systems Protection Board, and remanded the case for further review.

The case itself involves the process for handling federal employee workforce complaints. Those complaints that fall under both the Civil Service Reform Act of 1978 and federal antidiscrimination laws are called "mixed cases." When the federal Merit Systems Protection Board dismisses a "mixed case," Ginsburg's opinion said, the proper place for review is the federal district court.

I think this bodes well for Conservative expectations from Gorsuch.

He seems to have respect for limits on SCOTUS?

This is the sort of thing that is an early great sign of Gorsuch coming as advertised. Terrific.

And Thomas has been such a lion for liberty for so long, he really has been a great man in serving his country.

I think the fact that Ginsberg wrote the opinion tells me she is retiring.

Or the fact that she wrote the brief could signal that Ginsberg is hanging on to the bitter end. I.e.: it could be her way of pointing out that she’s still up to the job.

My sense is that she’ll retire the way Ted Kennedy did; namely, when she has to be carried out by six pall bearers.

It’s unlikely. Ginsberg was urged to retire while Obama was POTUS. She hung on, perhaps counting on a Hillary win. At this point she’s pretty much locked in. If she retires, she’ll be reviled in perpetuity for handing the choice of her replacement over to the hated Trump.

If one of her illnesses has recurred, things change. But I haven’t heard that rumor.

In any case, we’ll soon see.
