Justice Ruth Bader Ginsburg was the only justice to join Sotomayor in dissenting from the majoritys opinion in Trinity Lutheran Church of Columbia v. Comer.
Writing for the court, Chief Justice John Roberts, joined in full by liberal Justice Elena Kagan, concluded that a state government could not categorically deny churches that have playgrounds from competing with other institutions in the state grant program.
The Free Exercise Clause protects religious observers against unequal treatment and subjects to the strictest scrutiny laws that target the religious for special disabilities based on their religious status, wrote Roberts. Applying that basic principle, this court has repeatedly confirmed that denying a generally available benefit solely on account of religious identity imposes a penalty on the free exercise of religion that can be justified only by a state interest of the highest order.
The grant program in question was run by the Missouri Department of Natural Resources. It argued that it was acting under a provision of the Missouri state constitution that prohibits any state money from going to any church, period.

The 13 original states wrote up their constitutions prior to the Federal Constitution and the inclusion the Bill of Rights.
Missouri was not one of the original 13.

Scalia had taken Kagan under his wing. His efforts may still be paying dividends.

US Supreme Court Justice Elena Kagan surprised a Wisconsin audience this week with news that she has recently taken to hunting with her ideological opposite, fellow justice Antonin Scalia.
“He’s made a huntress out of me,” Kagan revealed at a Marquette law school panel in Milwaukee on Tuesday.
The liberal justice revealed she and her ideological foe had shot quail and pheasant together and planned to hunt bigger game in the future.
“He insists I’m going to shoot myself an antelope,” the New York City native said, adding that she had come to view hunting as “really good fun.”’
I see Radical Mistake of putting people on the Supreme Court to fill quotas.
There were several hundred more qualified for the Supreme Court.
Doesn’t sound like a very “wise latina” with a “compelling life story” to me.
The radical mistake is the belief that the federal government has a say regarding local playgrounds in the first place.

I see radical mistakes in electing a president who appointed such an affirmative action ignoramus to the Supreme Court.
Only two current State Constitutions in place predate the US Constitution. Massachusetts (1780) and New Hampshire (1784).
