JOINT STIPULATION OF DISMISSAL WITH PREJUDICE: IT IS HEREBY STIPULATED AND AGREED, by and between the parties, that (i) International Mineral Resources B.V. (”IMR”) withdraws all allegations in its 28 U.S.C. § 1782 Application (the “Application”), including allegations therein that ECVK, Mr. Salisbury or Salisbury & Ryan LLP engaged in any unlawful or improper acts against IMR, including but not limited to hacking any information from IMR’s computer systems, disseminating any information as part of a smear campaign against IMR, (ii) Mr. Salisbury, Salisbury & Ryan LLP, and EYCK withdraw all allegations in their briefing in this action, including allegations therein that IMR or its representatives engaged in any unlawful or improper acts against Mr. Salisbury, Salisbury & Ryan LLP, ECVK, or any other person, and (iii) this action shall be dismissed with prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1) (A)(ii), with each party to bear its own costs and fees.
