Judge Calls NYPD's Handling Of Precarious Civil Forfeiture Database 'Insane'

In the middle of the night in March of 2012, NYPD officers burst into the Bronx home of Gerald Bryan, ransacking his belongings, tearing out light fixtures, punching through walls, and confiscating $4,800 in cash. Bryan, 42, was taken into custody on suspected felony drug distribution, as the police continued their warrantless search. Over a year later, Bryan's case was dropped. When he went to retrieve his $4,800, he was told it was too late: the money had been deposited into the NYPD's pension fund.

“Contrary to some published reports suggesting that NYPD does not electronically back up the data in its Property and Evidence Tracking System (PETS), all such data is backed up continuously in multiple data center,” stated Deputy Commissioner Stephen Davis.

Why, at this point didn’t the Attorney demand an Immediate Investigation for Perjury Charges against Schedler? Demand Sanctions, Force this clown Davis under oath.

Why would a Judge willfully Allow Perjured Testimony in his courtroom? The judge should issue a Contmept Citation against the tech that gave the affidavid and have him arrested, then watch the truth come out.

1. End civil forfeiture
2. Repeal RICO
3. If a defendant is found to have used ill-gotten gains in his defense, then an amount equal to the ill-gotten gains used should be tacked onto whatever fines he is required to pay.

A person (and his property) should be considered innocent until proven guilty. If proven guilty, then you can punish the defendant for the additional crime of misusing ill-gotten money and goods.

Instead of individuals going up against the NYPD and having to spend more money in legal fees to get their money and stuff back, this is a ripe occasion for a class action lawsuit.

If one wonders what ever happened to our 4th amendment rights, thank the little tin god thugs who work for the US government. This is simple, Constitutional and the right thing to do; there should be no personal property confiscation unless and until a person is convicted of the crime. If conviction is overturned, the person gets back everything that was taken, down to the last cent no matter how much time has passed. Obviously, unbridled power certainly does corrupt.

I hope he’s suing for ownership of the NYPD HQ.

Deprivation of rights under color of law. Every b*tard cop that was involved should be locked up for a minimum of 10 years.

And they wonder why an increasing number of people don’t trust them. When they take a dump all over your God-given rights, people start to lose faith.

They’ll just lie anyway, then conveniently be out of the country if it ever comes to light.

The people that need to be thrown under the jail never get caught.

I doubt that that the NYPD would go breaking down doors without warrants if there was a greater chance of their asses getting shot at...

Believe the word you’re looking for is: ILLEGAL.

Though, I’ve got quite a few to add to the list as well, but don’t want to get a time-out.

Say, has anyone found the 1st instance of govt charging a *thing* instead of the owner\a person??

(The whole idea of charging the possessions, as if the possessions were an entity unto them-self, is asinine. I presume the true owner is forbidden from representing for said possessions in court. How does one cross $4200 during trial...what ?\answers does one expect? Shakespeare had it right...)

Because it’s a big ol’ revolving-door of govt vs. The People? The whole ‘wall of blue” vs. “wall of black”, scratching each others back.

And, what private lawyer would even TRY to take up the case for the guy over the same? Their big payday\path-up-the-ladder might be stunted\turned-off.

Sorry, but IMO, the whole govt need revamped; Judicial most of all.

Civil forfeiture must be completely eliminated. It’s outrageous that Congress has not acted on this.
