State of New Jersey Caves on Stun Guns: No More Ban

Taser

New Jersey is close to dismantling its total ban on stun guns for people who are not government agents. The ban was put in place in 1985.

Stun guns or Tasers, are commonly available to New Jersey Police officers. 138 law enforcement agencies in New Jersey have the devices.

From nj1015.com

A total of 138 law enforcement agencies in New Jersey currently have stun guns, or Tasers, on hand, an office spokesman said Wednesday.

The ban was challenged with the Supreme Court unanimous decision in the Caetano case in Massachusetts. On 21 March of 2016, the Supreme Court issued a remarkable and, apparently to the Court, non-controversial decision.

In the Caetano PER CURIAM decision (pdf), the Court held that:

The Court has held that “the Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding,” District of Columbia v. Heller, 554 U. S. 570, 582 (2008), and that this “Second Amendment right is fully applicable to the States,” McDonald v.Chicago, 561 U. S. 742, 750 (2010).

The decision, which was unanimous, has far reaching implications beyond mere stun guns.  Stun gun bans have already started falling like dominoes.

Caetano has far reaching implications.

The decision was very clear.

All bearable arms are protected by the Second Amendment.

this falls under the definition of a “Weapon”
hence, why NJ did not fight this ruling
so, overlapping laws state if you carry or conceal or use one in self defense, your still going to jail..

I’m more worried about arm-able bears!

They’re dangerous enough as it is.

why in t.h.e hell did they ban them in the first place? Being a democrat state- you would think they would ban guns before they banned non lethal devices like this?

While I agree in principle, there’s some pretty nasty man-portable stuff floating around out there.

They are Democrats. They worship the state as God.

You expect rationality from them?

It’s Jersey.

Those Jersey Democommies and their RINO f-tard allies find a way to f*ck it up for the people.

I'm pretty sure the British thought the very same thing in the 1770's.

So let Muhammad Smith down the street, next to the airport, buy a Stinger or similar system if he can afford it?

What is the maximum ‘size’ weapon a United States citizen should be allowed to have?

Probably rifles and pistols, and their future analogues, would be what the Founders had in mind for individual possession, with field pieces and their equivalents being held in local Armories. So today that would translate to lawful ownership of basically everything (to include automatic rifles) at a scale below explosive devices such as grenades, mortars, missiles, artillery and up. What more would be needed to mount a successful insurgency by the bulk of the populace against a tyrannical government?

If my history is correct, the colonies needed the privately owned warships to win the revolution.

Someday, we may need the same size of weapons.
