The Texas church shooter should not have been legally able to buy a gun

The federal government's firearm transaction record, which buyers must legally fill out, asks about felony convictions. Kelley bought a Ruger AR-556 rifle, used in the attack on the church in Sutherland Springs, Texas, in April of last year from an Academy Sports & Outdoors store in San Antonio, a law-enforcement official told CNN.

The purchase of the gun took place two years after Kelley had been court-martialed, imprisoned, and discharged from the military.

Academy Sports sold an AR and didn't call it in to NICS? You sometimes hear of small stores not doing it out of laziness but Academy Sports? I have never known a major chain not to call a gun purchase in.

Why didn't it flag when the form was submitted? Was Academy Sports informed? Did they alert the police?

Man, they have deep pockets, too; I can hear the lawyers' wings flapping as they circle like buzzards. They are so going to eat it if this turns out to be true.

Well, being denied a license to carry is not the same as “can’t purchase a rifle”.

If they deliberately violated the law then civil suits should be the least of their worries. Criminal action against them would be called for I would think.

I’d read on another thread that he lied on the 4473, and it wasn’t caught by NICS.
He used a Colorado Springs address.

What level of court-martial was it?
A summary court-martial would just be a misdemeanor.

Dishonorably discharged. That leaves a mark that is extremely hard to erase, but then, apparently his violent history goes much deeper, almost to the Lee Harvey Oswald degree.

And Oswald only fired a few shots.

Bolt-action. None of these wussy semi-automatic AR type rifles.

I posted this on another thread a few minutes ago:

I believe he received a Bad Conduct Discharge. Even if he lied on his FFL app the background check would have precluded him from being eligible for buying, possessing firearms if he had been given a Dishonorable Discharge.

I don't understand the domestic abuse charges and still being able to possess/buy firearms.

BTW, Kelley reportedly had multiple firearms in the vechile when stopped.

Don’t know about this mass shooter, but most can pass the background check. Adam Lanza could legally buy a rifle, but not a handgun due to his age. The Columbine shooters were to young and used a straw buyer instead.

Your common criminal never goes thru a background check, even if he could pass it. He doesn’t want a gun tied to him.

Point; Background checks will never stop most shooters.

Everyone answers a series of written questions buying a gun. If he answered any of the falsely he bought it illegally. He was denied for CCW but each buy requires all those questions.

Are you sure, I hear it was a Bad Conduct Discharge, not a Dishonorable Discharge. Two different things.

If they asked for Other Than Honorable it would be a different matter again.

Adam Lanza would have been refused if his Psychiatrist was worth a damn. They have mental health requirements also on the form.

My copy of the second amendment does not appear to preclude freed felons, traitors or crazies from owning and carrying arms. Anyone who should not be armed should not be running around loose!
