Maybe, but a threat of a big-money lawsuit can sometimes bring clarity to mind. But then.. in the WaPo we are talking about a gaggle of libs here...
Oh come on. Papers like the Washington Post are threatened with lawsuits all the time. Very few go to court and even fewer result in rulings against the paper. If the Post cringed at every threat then they wouldn't publish anything.
