Peruvian farmer sues German energy giant for contributing to climate change

A Peruvian farmer won a small but significant legal victory on Monday when a German court said his appeal against energy giant RWE, which he accuses of contributing to climate change that is threatening his Andean home, had merit.

After hearing oral arguments from both sides, the higher regional court in the western city of Hamm said Saul Luciano Lliuya’s demand for damages from RWE was “admissible”, paving the way for the case to proceed.

Luciano argues that RWE, as one of the world’s top emitters of climate-altering carbon dioxide, must share in the cost of protecting his hometown Huaraz from a swollen glacier lake at risk of overflowing from melting snow and ice.

The appeal court’s decision not to throw out the case immediately, as a lower court had done in the first instance last December, was hailed as a win by climate change activists.

The court in Hamm has written “legal history”, said Klaus Milke, chairman of the pressure group Germanwatch that is advising Luciano.

“It’s good news for the many potential plaintiffs worldwide who will be emboldened to take action themselves,” he told AFP.

Then I found the answer in the article. He is just being used.

I wish just one of these CEO’s of a Major Energy company would grow some balls and man up, SHUT DOWN THE PLANT and DISABLE IT PERMANENTLY! Let them live in the Dark and Cold.

A German court says that the farmer's case has merit.

Oh man, this is great! My front lawn has dead spots due to the hot summer. Yeah, that's the ticket. The hot summer ruined my lawn, and caused me mental anguish.

I'm going to get my personal lawyer on this. We'll sue Germany for its outrageous, egregious, and preposterous behavior.

I think I’ll join the suit as a 3rd party plaintiff; I want whatever the farmer gets from the energy company on the theory that he’s been growing coca plants, and the cocaine from the plants has been ruining my community, causes me to buy guns for self-defense and pay outrageously higher taxes for a criminal justice and health care system to deal with the criminals and addicts his drugs have created.

I can play that game too.

No, "Klaus Milke, chairman of the pressure group Germanwatch that is advising Luciano" is the one instigating this. The Peruvian farmer is just the Poster Child to tug at the heartstrings of the German courts & populace [and their purse strings for 'charitable donations'].

This is a common tactic everywhere. Normally an organization can’t sue for such things as climate change unless they can allege actual personal damage or else the case will have no standing. So the organization goes shopping for a plaintiff to be the face of the lawsuit, and with as many factors that will increase sympathy.It’s done in the United States all the time. One of the most famous cases here involved Rosa Parks and the civil rights movement.

At the very least RWE should counter-sue to be recompensed for providing more CO2 to grow his crops (CO2 = plant food).
