so, does the Gray family have to give the settlement money back ? a settlement that happened before due process ?
I have to say that I am normaly on the side of police. But not here. This is a great reason for states to do as Wisconsin does. If a policeman injures someone in a police action, the state does the investigation, not the local authorities.
A local prosecutor can not prosecute his own police force. Thats crazy. He depends on them to do all the work. The friends and co workers of the policeman will be the ones finding evidence.
And so you have the case you have here in Baltimore. The prosecutor brings the case to court incorrectly on purpose. The police are charged with the wrong crimes so they will not be found guilty. Either they are charged with 1st degree murder when its clearly man slaughter or they are charged individually when its clearly a group act. There is nobody who will testify with certainty. The other cops say they are not quite sure. They don’t recall. And the physical evidence is collected with an eye toward getting someone off. Not convicting them.
The reality her is that a man was captured and his spine was crushed afterwards. How, we don’t know. But he was in police custody the whole time. The perp was in cuffs. So its the police responsibility for his welfare. The perp is innocent until proven guilty and the police decided to cuff him and put him in a wagon. So they own the responsibility for his well being until court. That is the law.
At least the locals aren’t looting & burning this time.
Meanwhile the violent crime rate in Baltimore continues to skyrocket. Cops refuse to stop locals from killing each other and look straight ahead, drive on and keep watch over parts of the city friendly to the cops and by sheer coincidence, have the lowest crime rates. that is exactly what I would do too.
