GOP Tax Reform Still Lets Illegal Immigrants Receive Child Credit Subsidy

The Republican tax reform bill would still allow illegal immigrants to claim a key tax credit, despite earlier calls from conservative lawmakers to end what they say is a multi-billion dollar annual reward for lawbreakers.

Under both the House and Senate versions of the Tax Cuts and Jobs Act, illegal immigrants with taxpayer identification numbers may claim the child tax credit for any of their U.S.-born children.

The original version of the Republican tax bill introduced in the House Ways and Means Committee stipulated that the refundable credit would not be available unless the “taxpayer includes the taxpayer’s Social Security number on the return of tax for such taxable year.” In other words, illegal immigrants, who don’t have legitimate social security numbers, would be ineligible for the credit, regardless of their children’s citizenship status.

When the bill was marked up in committee, though, the provision was amended with language mandating only that the qualifying child have a social security number, not the taxpayer. The amended language allows illegal immigrants to continue claiming the credit, which would be doubled to $2,000 per child, for their U.S. citizen children.

A video report came out years ago showing how the illegals claim many kids, some of them living in Mexico, and the IRS just paid the refunds without question. They rake in many millions of dollars that way.

They aren’t just claiming citizen kids. They are claiming other relative that live in Mexico and kids that don’t exist. The IRS doesn’t question it.

Leave it to the GOP to shoot itself in the foot.

And as far as repealing the individual mandate, it’s kind of an empty gesture now that low cost plans are now available thanks to Trump.

Back during the Carter years they would pay deposit on a pole meter and use that to get the "Crazy Money" from the stupid Yankees.

This is outrageous. Asshat RINO Senators like Corker and Flake force the AMT to remain and individual tax cuts to expire, but conservstives cannot stop illegal aliens from getting tax credits. The cheap labor express party lives on!

The tax credit was not invented to pay to illegals. ‘The tax credit was invented to give money to dedicate to the citizen child. So your question about who receives it is still a matter for the courts as it has been awarded to the family using the 14th amendment interpretation by the feds for many years. Overturning precedence can be a tough haul both in the courts and the media.

Like I mentioned before according to the Constitution’s 14th Amendment, ratified in 1868 to ensure citizenship for the newly emancipated African Americans, “all persons, born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.” Whether or not they are children of illegals or citizens, they are considered citizens per jurisdiction.

That makes the person born here eligible for the credit and the feds have been giving it away for a long time. Two things will have to happen to curtail it: 1. a re-write of the constitution disclaiming this practice completely, or 2. A court case that will reach the scotus and may or may not be heard and possible kick down the road one way or appealed the other. I didn’t say I agreed with the practice. I just tried to indicate what the situation is.

And God help the congress that wants to take food out of the mouths or clothes off the backs of “those poor” children. And the president that signs that bill will be murdered in the press and ruined politically forever. It will hit every news source in the world. And I don’t think it is a good time to take on that one, a definite no win, after all the gains. That one would be political suicide for the conservatives, right or wrong. They need to pick their battles, and not step up to be internationally hammered for this one topic with so much still to be done. They can’t win this one in a short burst. It will take years of punishment and no need for a recount at the next election.

The parents may be foreign nationals, but the kids born on US territory are citizens under US jurisdiction. That’s the problem. The solution will be painful.

Agreed. One of the things that pisses me off about the libs is their continual wanting more legislation that costs money and time to create. It normally muddies the intent of the law, and is an easy way to not get a damn thing done.

The solution here is not to make more laws, just enforce the ones on the books. But do it legally and correctly. I remember so many times the conservatives were hammered in the press for doing something the libs didn’t agree with. And this leads to lost seats in congress and president’s seat. And we’re right back where we started, maybe worse.
