Indeed, the repeal of the Obamacare mandate is one of the great civil rights victories of our times. Obamacare violates our inalienable natural rights/property rights in critical ways. First, it compels you to purchase an insurance product you may not need or want in terms dictated by the government. In a free society, you would be free to negotiate the terms and coverages of the plans, deductables, price, etc. For example, an elderly couple doesn't need pregnancy benefits, infant annihilation coverage, or coverage for any minor children.
When I was working, we had two health insurance choices---Self, or Self and Family. This is hardly just. What about Self, Self and Spouse, Self and Spouse + one child, + two children, etc? Why should a couple with one child pay the same premium as a couple with five children? Obamacare compels one to pay for the insurance of others. This is the most unjust provision of Obamacare---compelling the few to support the many. This completely runs in the face of our Natural Rights.
(This is off-topic, but the same principle---school taxes---should be levied according to how many children you have enrolled in the system. A childless couple should pay no school taxes. Nor should families who choose to home school or send their children to private or parochial schools. Only families with children in the public school system should pay school taxes. Remember---contrary to the Old Testament, you are NOT your brother's keeper.)
Health insurance should rightly be one the most individualized products or services one will ever buy. One should be able to purchase health insurance "cafeteria style." You would pick and choose from a menu of benefits and coverages best suited to your life's circumstances, starting with the number of people in your family requiring coverage. But the government has pretty much eliminated choice and supplanted it with one-size-fits-all loaded with mandatory benefits many of us don't need or want. (Remember---contrary to the Old Testament, you are NOT your brother's keeper.)
One of government's primary functions is the defense of our country. Yet, we do it with an all-volunteer military, and the enlister gets to pick from among our existing armed services. Why can't we have an all-voluntary health insurance?
I know three people who quit working because of the mandate fine.
The government can say people shouldn’t pass costs on to others. It has no right to require us to buy a particular service or product.
People are either capable of making their own decisions or they aren’t. If liberals believe they aren’t we won’t be a free society for much longer. That is the bottom line.
If the government continues to require insurance companies to pay for pre-existing conditions, then the only fair thing is to force everyone to buy health insurance or take a certain percentage of everyone's income tax and give it to the insurance companies.
I'm totally against forcing the insurance companies to have to cover pre-existing conditions, but so long as that is in place, the only thing that makes sense is forcing everyone to pay.
The libertarian notion that if there are two bad ideas in place that it is always better to get rid of one of them is fallacious. That sort of reasoning says look the other way on illegal immigration even though the welfare state hasn't yet been abolished resulting in illegals going on welfare.
So if John Doe (or me) did not have any health insurance in 2017, will he face the penalty when filing his taxes in April of 2018 in accordance with the law at the time of the previous tax year?

I don’t know. The SCOTUSA made the ACA mandate fine a tax other wise it would have been illegal. The tax reforms abolishes individual mandate tax.
Or put another way:
Obamacare is in direct conflict with the 13th Amendment that states that “Neither slavery or INVOLUNTARY SERVITUDE shall exist in these United States unless for crime or punishment.” (Paraprase, not exact).
Being forced to pay for insurance or healthcare for others and/or being forced to subsidize pre-existing conditions IS INVOLUNTARY SERVITUDE.
It’s soooo unconstitutional.
